REVISION OF 10 CFR 20.403 On Wednesday, July 13, 1988, a meeting was held in Room 789 in White Flint.
The purpose of the meeting was to discuss the proposed changes to 10 CFR 20.403 that had been previously suggested at the last meeting. The attendees at the meeting are shown below:
John Buchanan, NRR James Wiggington, NRR Ed Flack, DE Justin Long, NMSS Don Cool, NMSS Kathleen Black, AE0D Anthony DiPalo, RES Joseph Hate, RES The meeting began about 1:30 pm with the introduction of all of the group members and a recap of the prior meeting which was held on Tuesday, June 30, 1988.
The major discussion today centered on how to correct deficiencies in 20.403 so as to get the Materials Licensees that fall under the purview of HMSS to report appropriate incidents while not causing any additional reporting requirements for licensees of nuclear power plants that fall under the purview of NRR.
~After about an hour of discussion including a recap of why 20.403 was originally requested to be revised, RES representatives recomended that the following action take place:

Delete the references in 20.403 relative to the loss of operations and the damage to property (Subsections 3 and 4) since these references would now t>e in parts 30, 40, and 70.
The remaining parts of 20.403 would apply to all licensees.
Representatives from OE and NMSS will consider this recommended course of action and advise RES not later than July 20, 1988 of their decision.
If we cannot arhieve some kind of an agreement with OE and NMSS, then any further work on updating 20.403 will be put on hold and all work on the project will be suspended.
If action on this rulemaking is suspended, this delay will affect the current, schedule and the two year time limit specified by the EDO for completing rulemakings.
