MODIFICATIONS TO COMPLY WITH SECTION III.G AND III.L OF APPENDIX R TO 10 CFR 50 Paragraph 50.48(b) of 10 CFR 50, which became effective on February 17, 1981, required all nuclear plants licensed to operate prior to January 1, 1979 to meet the requirements of Sections III.G, III.J and III.0 of Appendix R to 10 CFR 50 regardless of any previous approvals by the Nuclear Regulatory Commission for alternative design features for those items. On March 19, 1931 Toledo Edison Company submitted design informa-tion f~ a modification to provide alternate service water capabilities to meet the requirements of Section III.G of Appendix R.
In that sulnittal, Toledo Edison Company indicated that with this modification the facility will comply with the requirements of Sections III.G. III.J and III.0 of Appendix R and that no other open items remain from the prior NRC review (cf. NRC letter November 24, 1980).
On March 23, 1982 Toledo Edison Company met with the NRC staff to discuss the design modification. At that meeting Toledo Edison Company indicated that two other areas of non-compliance with Appendix R requirements had been identified and that exemptions would be requested for these two areas.
The exemption requests were submitted by letter dated April 29,1982 (No.
815) and are under consideration.
The NRC staff has reviewed the proposed modification to provide alternate service water capability and has found it to be acceptable. Based on this approval the required schedule for implementation is as given in Paragraph 50.48(c)(4) to 10 CFR 50.
Our Safety Evaluation Report on this issue is the enclosure to this letter.
