PREHEARING CONFERENCE ORDER (Schedule) g.O

A prehearing conference was held in this proceeding on February 9-10, 1982, at Oak Ridge' Tennessee, pursuant to notice duly published in the Federal Register.

Counsel representing-the Applicants, Staff, Intervenors -

(NRDC and Sierra Club), State of Tennessee, and City of Oak Ridge participated in the conference.

The following schedule, discussed at the conference, shall govern the course of this proceeding for evidentiary hearings on the application for issuance of a limited work authorization (LWA).

February 11, 1982 Prehearing Conference Order. Necessary further discovery on all admitted contentions shall ccmience immediately.

The parties shall confer at the earliest possible time and attempt to agree upon the admission of new contentions, dis-covery, and amending or updating prior discovery. Discovery will be limited to two rounds. The parties shall attempt W61 to obtain all relevant information g

follow-up matters. The rules concerning discovery set forth in the Comanche Peak case,14 NRC 150 at 154-57, are incorpo-rated herein by reference.

March 5,1982 Last day for filing new/LWA-2 contentions.

March 19,1982 Last day for responses to new/LWA-2 contentions. No later than this date the parties uill file with the Board pleadings addressing areas of discovery upon which no agreement can be reached.

April 30,1982 -

Last day for responses to outstanding discovery on existing contentions and amendments of prior responses to discovery on existing contentions.

Response

intervals will be in accordance with the Rules of Practice. Discovery requests must be initiated in sufficient time to permit responses to be made within those time limitations. Objections to discovery requests or the responsiveness of answers shall be made promptly after counsel have conferred and attempted in good faith to resolve their differences.

June 18, 1982 Last date for discovery responses; discovery closed on all pending contentions except new matters first raised in subsequently filed Staff milestone documents.

June 22, 1982 Staff's environmental update to be issued.

The parties shall immediately confer and attempt to agree on discovery and conten-tions based upon new matters first raised in the environmental update.

June 29, 1982 The Board will meet with the parties to consider pleadings or discovery issues 1

concerning new matters first raised in the Staff's environmental update.

Discovery on such new matters, if any, shall start immediately.

, July 9, 1982 Staff's LWA-2 SER and SSR to be issued.

July 16, 1982 The Board will meet with the parties to settle pleadings and discovery of such new matters.

Discovery thereon shall commence immediately..

August 6, 1982 Last day for responses to outstanding discovery on all new matters required by the Staff's milestone documents.

August 13, 1982 Written direct testimony to be filed.

August 23, 1982 Final prehearing conference.

August J4, 1982 Evidentiary hearings commence.
