ORDER On July 1,1982 the Department of Energy (D0E), for itself and on

behalf of its co-applicants Project Management Corporation and the 3

Tennessee Valley Authority, requested the Nuclear Regulatory Commission l4 (NRC or Comission) to grant an exemption from 10 CFR 50.10 pursuant to 10 CFR 50.12 to conduct site preparation activities for the Clinch River Breeder Reactor (CRBR) prior to the issuance of a construction permit or I
3 limited work authorization.
In response to DOE's previous request for 24 such an exemption, the Commission determined that an infomal proceeding

directed by the Commission itself was best suited for consideration of
@B the merits of such an exemption request.

Because DOE's current request for an exemption raises issues similar to 3
those raised by its previous exemption request the Commission believes b._.

This informal proceeding will be kept separate from the construction permit proceedings.

Natural Resources Defense Council and the Sierra Club, and any I
other interested person who files written coments in accordance with the attached schedule.1/ The NRC staff will not participate as a party to this proceeding.

The dates for filings and oral presentation are set forth in the attached schedule.
On July 9,1982, the Sierra Club and Natural Resources Defense Council filed a Motion for Summary Denial of Applicants' Section 50.12
