CLASSIFICATION OF THE MORGAN REPORT (U)
Purpose:
To inform the Commission of the receipt of a le,tter from the Departmnt of State regarding.the Morgan Report.

Discussion:
Enclosed for your information (Enclosure 1) is a letter dated July 2,1982 from the Departant of State in response to our request for State's views regarding classification of the so-called " Morgan Report".

In this regard, since foreign policy considerations were the i
basis for NRC's original classification of the docuiTent, we asked for State's views (Enclosure 2) regarding the appro-priateness of downgrading or declassifying, in whole or in part, the Morgan Report itself or any of. the related documents.

' As noted in the July 2,1982 letter, State continues to:
believe that the documnts were properly classified " Secret" and should continue to hold that classification.

Discussion With regard to advising Congressman Ottinger on the outcome JContinued):
of our reexamination of this classification matter, which NRC promised to do in the text of its inserts to the record for the March 3,1982 authorization hearing of the Sub-committee on Energy Conservation and Power, House Comittee on Energy and Comerce (Enclosure 3), the staff believes it would be premature to go forth with a response at this time, in light of the pending lawsuit by the Nuclear Club.
- Instead, the staff plans to prepare a response to Congressman Ottinger following a court decision on the matter.
