This is in further response to your letter dated July 26, 1982, in which you requested, pursuant to the Freedom of Information Act, documents relating to the nuclear materials safeguards program of the International l

Atomic Energy Agency (IAEA).

The documents listed on Appendix A, which are enclosed, are being i

released in their entirety.

The documents listed on Appendix B are being withheld in whole or in part as explained herein.

The segregable nonexempt portions are enclosed with this letter.

Documents 1 through 8 j

of Appendix B are being withheld in their entirety pursuant to the exemptions cited on the Appendix.

Portions of documents 9 through 16 of Appendix B are being withheld pursuant to the exemptions cited on the Appendix.

Documents withheld pursuant to exemption (1) consist of information classified pursuant to Executive Order 12356.

This information is being withheld from public disclosure pursuant to exemption ~(1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1).

Information withheld pursuant to exemption (5) constitutes advice, opinions and recommendations of the staff.

This information is being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5).

Document 14 of Appendix B is a transcript of a closed Commission meeting.

As specified in the Commission Determination Statement attached to the transcript, portions of the transcript are properly classified pursuant to Executive Order 12356 and are exempt from public disclosure pursuant

- to Exemption (1) of the Government in the Sunshine Act (5 U.S.C. 552b(c)(1))

and 10 CFR 9.104(a)(1).

These portions are being withheld from public disclosure pursuant to Exemption (3) of the Freedom of Information Act (5 U.S.C. 552(b)(3)) and 10 CFR 9.5(a)(3) of the Commission's regulations.

The transcript, with exempt portions deleted,is enclosed.

Eldon V. C. Greenberg, Esquire Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The persons responsible for the denial of documents 3, 4, 5, 6, and 15 of Appendix B are the undersigned and Mr. James R. Shea, Director, Office of International Programs.

The person responsible for the denial of documents 1, 2, 7, 8, 9, 10,11,12, 13, 14, and 16 of Appendix B is Mr. John C. Hoyle, Assistant Secretary of the Commission.

The denials by Mr. James R. Shea and myself may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision."

The denial by Mr. John C. Hoyle may be appealed within 30 days to the Commission and should be addressed to the Secretary of the Commission.

The review of additional documents subject to your request is continuing.

When we have completed our review, you will be advised of our determination.
