OF U.S. INTERAGENCY GROUPS ESTABLISHED TO UPGRADE IAEA SAFEGUARDS I'u rpose :

(U) To inform the Comission of existing interagency groups involved in U.S. ef forts to upgrade I AEA safeguards and to provide a brief report on the status of their activities.

D_i scus s ion :

(U) In early 1976, an interagency group was formed and charged with oversight responsibility for U.S. international safe-guards policy.

This group, the Interagency SLcering Group (ISG), includes high-level managers from the Departments of State and Energy, the Arms Control and Disarmament Agency, the National Security Council, and the NRC.

The Director of the Office of International Programs and the Director of the Division of Safeguards, Office of Nuclear Materials Safety and Safeguards are the permanent NRC representatives to the ISG.

(U) Due to cempeting demands upon the time of some of the members,

the ISG has met irregularly over the past several years. In the absence of regular meetings, safeguards issues have been dealt with through existing office and agency mechanisms, and agency positions have been coordinated at the staff level.

However, recent events have illustrated the need for greater interagency coordination at management levels and efforts are being made to " revive" the ISG.

Subsequently, representatives of State, ACDA, 00E and MC develcred the "U.S. a tion Plan - Measures to Strengthen I AEA car g ards" c

(Actico Plan) to integrate cn-going U.S. activities and identify additivnal steps to correct specific deficiencies in the implem.entation of I AEA safeguards.

The Action Plan is structured in terms of the following major areas:

Informtion Mceds, Safeguards System Cesign, Safeguards Technology Improvement, The Inspectorate, State Systems of Accounting for,and Control of, Nuclear Materials, IAEA.tsources, and U.S. Planning.

(U) In 1978, the Action Plan Working Group (APWG) was established and charged with coordinating as well as periodically updating the activities cutlined in the Action Plan.

The AFWG meets monthly and is chaired by a representative from ACDA.

Both IP and NMSS are represented on the AFWG.

(U) As noted above, the APWG is primarily a coordinating group rather than an implementation group.

Most of the activities cutlined in the Action Plan continue to be implemented by individual asc-ncies.

This rethod of implementation means that, for the most part, implementation of the items enumerated in the Action Plan is dependent upon the resources each agency is willing or able to commit to the improvement of IAEA safeguards.

There are several reascns for this, including the (Continued) lack of adequate staff-years being devoted to the Action Plan cn the part of scme agencies, which has resulted in the post-ponement of scme meetings and frequent failures to meet established deadlines.

Another reason is the apparent reluctante;in sena cases, of the Executive Branch agencies to pursue reco mandations which they judge to be pol.itically sensitive.

(U) For ycur ready reference, the s taff has prepared a s tatus report on the Action Plan at Attacbent B.

It must be emphasized that this report focuses on individual items in the Action Plan and dees not purport to represent an evaluation of I AFA safeguards generally.

I:. deed, a casual reader of the status report might well come away with a more oatimistic view of the state of the I AEA safeguards system than is werranted.

The reason for this is that the Action Plan does not address what we have come to recognize as some of the IAEA's most serious' weaknesses, which, as characterized in the Cemmission's Cecember 2,1981 congressional testimony,. are its hesitancy to act against a member state, its acceptance of constraints imposed by member states on inspections, and the tendency on the part of its senior officials to be overly cautious about facing irgartant issues.

Remedies for these weaknesses will require much high-level attention.

(U) In early 1981, the APWG selected a list of activities which would be given priority attention, so thc.t limited agency resources could be focused most effectively.

However, even with this more modest program, a number of priority activities are already behind schedule.

(U) Although each APWG agency operates with limited resources, NRC offices have consistently provided policy and technical contributions through the Action Plan.

(An NMSS status report for the last quarter of CY'81 is provided at Attachment C.)

Many of the tasks involve foreign policy aatters for which State and ACDA have primary responsibility.

However, these same agencies are the most limited in terms of staff-years devoted to implementing the Action Plan.

This is especially significant in light of their ultimate responsibility for improving IAEA safeguards.

Technical Support Coordinating Committee (TSCC)

(U) The TSCC was established by the ISG to oversee the U.S. Program of Technical Assistance to IAEA Safeguards (POTAS).

NMSS provides a permanent NRC representative to the Ccmmittee.

Discussion:

(U) Fstablished in 1976, POTAS was intended to complement other

'(Continued) resources available to the I AEA (i.e., the IAEA's regular budget and the support programs of other countrics) and is by far the largest extra-budgetary source of safeguards support available to the IAEA.

Assistance is provided through F0iAS in five general categories; Fqui; ment and S tandards,

Experts,
Studies, Techniques, Procedures, and Equipment Evaluation, and Training.

(U)

F0TAS is intended to meet urgent safeguards needs more quickly than can be achieved through normal IAEA administrative procedures.

Special expertise is made available to strengthen IAEA capabilities in areas where such expertise is limited.

In areas where U.S. research has developed and tested advanced techniques applicable to international safeguards, results are made available to the IAEA.

Scre 20 individual types of material verification or containment / surveillance equipment have bcen developed and provided to the I AEA.

Although four types of POTAS-developed equipment are new in routine use by the IAEA, nost of the equipment is being field tested.

POTAS resources are also used to assist the IAEA in training inspectors.

(U)

Funds for POTAS are budgeted by the Agency for International Development, and the overall technical implementation of the program is menitored by the International Safcguards Project Office (ISP0) at Brockhaven National Laboratory under DOE auspices.

(U)

Recently, State assumed the Chairmanship of the TSCC, but 00E will continue to monitor the POTAS program through ISP0.

During a recent interagency meeting, one official from State noted that much of the safeguards equipment developed under P0TAS is not in use or is of little interest to IAEA inspectors and that IAEA safeguards technical needs should be reviewed and priorities should be established.

Of the $4.1 million budgeted for FY-82 for POTAS, about 53 milli 6n is earmarked for continuing high priority tasks and $800,000 for ISP0 operations costs.

By comparison, State estimates that about $9.3 millien is needed in FY-82 to carry out high-priority tasks that are not being pursued adequately at present.

(U) The General Accounting 0,ffice (GA0) criticized POTAS (Continued) in its recent review of the Nuclear Non-Proliferation Act (The Tluclear Non-Proliferation Act of 1978 Should Be Selectively ModifieJ; May 21,1981 ; OCG-81-2).

GA0 concluded that despite the efforts of POTAS, "many urgent needs have not yet bcen a et and further improvarc.ents are needed." GA0 also found that the I AEA '.ns experiencing problems in absorbing the results of POTAS and that the IAEA has becc.no

that the Secretary of State, in consultation with the Setretary of Energy, the Director of the Arms Control and Disarc:n.xnt Agency, end the Nuclear Regulatory Ccmission, reconsider the direction and scope of POTAS, in light of (1) the original intent of the program, (2) the provisions of the Nuclear Ncn-Proliferation Act of 1978, (3) the increasing dependence of IAEA en this U.S. program, and (4) the need to retain the international character of the IAEA safeguards system.

(U) As noted above, State has recently assumed the Chairmanship of the TSCC.

At the most recent TSCC meeting new monitoring procedures were adopted, including:

(1) preparation by ISP0 of monthly expenditure reports,

(2) c,uarterly status reports on POTAS tasks, (3) detailed cost estimates for all tasks, and (4) redrafting of the statement of goals for the TSCC and F0TAS.

(U) Other actions which have been initiated are also intended to be responsive to GA0's recorr.endation.

(U) US/IAEA Safecuards Aoreement Working Grouo_(SANG)

The SAWG was established to monitor the implementation of the Agreement Between the United. States of America and the l

International Atomic Energy Agency for the Application of Safeguards in the United States of America (the Agreement).

The SAWG is chaired by State and includes representatives l

from ACDA, DOE and NRC (Attachment C).

Discussion:

(U) During the first half of 1981, the SAWG met frequently to (Continued) consider:

(1) the classification and handling of sensitive IAEA docwents; (2) the designation of IAEA inspectors for the U.S.; (3) revisions of the list of U.S. facilities eligible for IAEA safeguards; and (4) the status of inspections at U.S. facili ties.

The SMlG new meets on an as-needed basis to assist in resolving any difficulties which arise in, the imph. rentation of the Agree: 1ent.

US/IMA Sa feouards Agr tement ilegotiating_Teg (U) The ::qotiating Teau was established by the ISG to negotiate with the IAEA the Subsidiary Arrangements (including facility attach. ants) and Transitional Subsidiary Arrangements required to inplc aent' the Agreement.

It is chaired by State and includes representatives from DOE, f!RC, and ACDA.

i; MSS represents tlRC on the ikgotiating Team.

The f egotiating Team has essentially complated..ork on the facility attachants for the Exxon icw-enriched fuel fabrication facility and the CP-S research facility at i.cgenne National Laboratory (a L10E license-exempt facility).

These attachments should be brought into force in the near future.

Negotiating Team comnents on the latest facility attachment proposals for the Trojan and Rancho Seco pc'.wer reactors have been provided to the I AEA.

(U) The Ccaission may recall that during Senate consideration of the Agrcement, some concern was expressed that its implementa-tion wculd adversely affect the operations of U.S. nuclear facilities.

In an attempt to mitigate the effect of imple-mentation, the tiegotiating Team has worked closely with U.S.

facility cperators to insure that the final attachments will be acceptable to the nuclear industry.
