-As required by Section P.4 of the above contract,1this . is. my' letter progress report for the period between November 1 and November 30, 1989. On November 7, I attended ~the-oral argument in Boston on the appeal taken by-Stephen B. Comley from the June 23,
- 1989, order ~ of the United States District Court for the
. District of Massachusetts that enforced the subpoena.ducas-tecum issued to Mr. Comley by the Commission last March at my. request. The members of the Court of Appeals for the First; Circuit. hearing.the appeal were Judges Bownes, Breyer, .and Selya. The argument.on. behalf of the NRC was presented-by Assistant United States Attorney Paul G. Levenson, who took over the matter in' September upon the departure fros' the office'of the Assistant United States Attorney who .previously had been assigned to it. Unless and until the subpoenaed e tapes are produced, further exploration of Mr. Conley's i relationship with Roger Fortuna seems pointless. Whatever decision is reached on this score will be perfectly satisfactory to me. -I ~ am happy to have been of. service to-the Commission in-this - J matter and am prepared to continue to play a role should L that be the desire'of the Commission and the Inspector .i General'.. On the-other hand,.I can readily understand why the' preference might be to allow' the Inspector General to 4 take' full 1 charge of any further investigation. My daily log is attached. As required, it reflects the { number of hours devoted each day to work specifically in the i performance of the contract and, if any, work as a member of the Atomic Safety and Licensing Appeal Panel. s p The contract costs incurred during this reporting period consist of my compensation.and travel expenses rela'tive to my trip to Boston to attend the oral argument _on the appeal taken by' stephen B. Comley. My compensation-is as follows: 1 8~ hour day 0 $500.00 per day $500.00 1 2 hour day 9 $ 62.50 per hour' $125.00 Subtotal $625.00 My travel _ expenses included: $198.00 round trip air . fare between Washington, D.C., and Boston, Massachusetts, h $28.00 for meals, and $11.10 ground transportation. Subtotal s$237.10 Total $862.10 All services were performed within the 7:30 a.m. to 6:00 p.m., period (as specified in Section B.3). .If any other information is desired, please let me know.
