Re Contract No. NRC-34-89-347

Dear Mr. Burns:

As required by Section F.4 of the above contract, this is my letter progress report for the period between May 31 and June 30, 1989.

During that period, I completed the preparation of a 55-page report in connection with Investigation 89-15, one of the two remaining investigations for which I am contractually responsible.

That offort entailed the review and substantial revision of the Statement of Facts that was drafted by the investigator detailed to assist me; the examination of the transcripts of the interviews conducted I

by the investigator; and the drafting ab initio of both the Introduction to the report and the Analysis portion of it.

In addition, I was involved in-preparations for the June 22 hearing on the Government's motion to enforce the l

subpoena ducas tecum issued to Stephen B. Conley in connection with the other still pending investigation.

For one. thing, I submitted an affidavit for inclusion in the papers filed by the Assistant United States Attorney in response to a filing on behalf of Mr. Comley.

For another, I spent the entire morning of June 22 providing the Assistant United States Attorney in her Boston office with information relevant to her argument at the hearing that afternoon.

I attended the hearing and supplied her with additional information and advice as required.

The federal district judge announced from the bench that he would enforce the subpoena and the following day g

l-entered an order to that effect.

To enable Mr. Comley to seek appellate relief, the subpoena is not returnable until July 10.

I cannot conclude the investigation until the l

subpoena matter is fully resolved and I obtain whatever tapes of telephone conversations between Mr. Comley and Roger Fortuna as may be produced in compliance with the subpoena.

ihe contract costs incurred during this reporting period consist of my compensation and expenses incident to my travel to Boston to attend the June 22 hearing.
