Stephen G. Burns, Esq.
U.S. Nuclear Regulatory Commission Mail Stop 16 H3 Washington, D.C.
20555 Ret Contract No. NRC-34-89-347
Dear Mr. Burns:
L As required by Section F.4 of the above contract, this is my letter progress report for the period between July 1 and July 31, 1989.
During this period, I submitted on July 3 my 55-page report in connection with Investigation 89-15, which had been completed the prior week.
Other than that, I devoted two. hours on July 7 to discussing matters pertaining to the investigation involving the Fortuna-Comley relationship.
That investigation is now on indefinite hold pending the outcome of the Conley subpoena enforcement proceeding.
Mr.
Comley is currently in civil contempt of the district court's June 23 enforcement order and, under a July 27 order, is required to pay a fine for each additional day he fails to comply with the subpoena.
For the first five days, the fine is $200 per day; for the next ten days, it is $500 per day; for every day thereafter it is $1000.
I have no idea whether, and if so when, Mr. Comley will decide to obey 4
the court order.
In any event, unless otherwise instructed, I plan to continue to hold the investigation in abeyance.
This may require an enlargement of the contract period, which now expires at the end of September.
,All services were performed within the 7:30 a.m. to I
6:00 Lp.m., period (as specified in Section B.3).
If any other information is desired, please let me know.
Sincerely, N
