.is my. letter progress-report for the period between May 1 and May 31, 1989, t

4 During that period, I issued (on May 2) a partial report on the investigation involving the-OI_ handling of the Ellison. allegations and certain related matters.

In addition, I met with (1) members-of the staff of the Senate Committee:on Governmental Affairs for the purpose of reviewing in advance of release' a report that that Committee is issuing in connection with-its inquiry into the manner in which'that investigation was conducted by the Office of Inspector-and Auditor prior to February 28, 1989, and (2) a member of the staff of the House Committee on Energy and Commerce for the purpose of reviewing a document prepared'by that staff in connection with a like inquiry.

instance,'my purpose was to endeavor to insure that the I

document in question did not contain any material concerned with the. substance _of the remaining portion of my l

investigation:that should not be-publicly disclosed at this juncture.

That endeavor was Inrgely successful in that (1) the Senate Committee staff members had honored a prior L

commitment to avoid including such material in that E

Committee's report; and (2) the House Committee staff member-

deleted certain material at my request.

p' As noted in my May 1 progress report, the other still open investigation for which I have contractual responsibility involves many broad assertions of wrongdoing l'

on the part of several OI officials and employees.

I have been closely monitoring the progress of the investigator detailed to assist me in the conduct of that investigation.

Although its con.pletion has been delayed because of a family t

emergency encountered by the investigator that necessitated her absence for several days, I expect that it will be L

2 possible to conclude the investigation and to submit my g

report by the end of June.

.As also noted in the May 1 report, I cannot conclude the balance of my investigation involving the Ellison allegations until the matter of the~ subpoena'ducas-tecum issued to Stephen B. Comley is resolved.

Because the federal-judge in Boston assigned to the action brought to enforce that subpoena will not hear the matter until June

'22, it.is apparent that the investigation will not come to an endfbefore July at the earliest.

In this circumstance, on May 22, I orally briefed the Chairman and (in a second meeting) Commissioners Roberts and Carr on the disclosures to;date in both open investigations.

Although Commissioners Rogers and Curtiss were unavailable, the legal assistant to the former attended one of the briefings.

Except as noted above, no problems or delays were encountered during the reporting period.

My daily log is attached.

As required, it reflects the number.of-hours devoted each day to work specifically in the d

performance of the contract and, if any, work as a member of the Atomic Safety and Licensing Appeal Panel.
