Dear Mr. Denton j

McGuire Nuclear Station License No. NPF-9 contains the following conditions:

Relief and Safety Valve Tests (II.D.1) 1 Prior to October 1, 1981, the licensee shall provide documenta-tion for relief valves, safety valves, aad associated piping

in accordance with the EPRI December 15, 1980 letter as approved by the NP.C and shall qualify block valves by July 1, 1982, and i

shall submit a report. demonstrating said qualificacion.

It is Duke Power Company's position that this condition has been satisfied to the extent possible at this time. As has been noted in previous correspon-dence on this subject, Duke Power Company is participating actively in the testing program conducted by EPRI. One of the stated purposes of this pro-gram is to resolve the concerns related to relief and safetv valve perform-ance as noted in NUREG-0737, Item II.D.1.

Mr. R. C. Youngdahl on December 15, 1980.

Subsequently, on July 1,-1981, i

another letter frem Mr. Youngdahl described several changes in the program 1 l schedule and scope.

On July 17, 1981 representatives of the NRC Staff, EPRI and the PWR Owners cepresentatiw s met and discussed the additional testing wh6c !

planned.

In this meeting it was noted that depending on the exact number of i

tests, the expanded program could take from 4 to 8 months longer than origi-

It should be noted that several other licensees have similar license cordi-tions and a decision to delay the-required completion date for this item is d -

currently pending bcfore the Comission (SECY ~ 81-491). However, since the McGuire license condition specifies an earlier submittal date than that speci-i fied for other licensees, expedited action is necessary'for McGuire.

Accordingly, it is requested that. the latest completion date specified in License Condition 11.j. be extended to July 1, 1982.

l The proposed ameadment is considered to be a Class II amendment pursuant to-10 CFR 170.22.

Therefore, enclosed is a check in the amount of $1200.
