On March 10, 1997, the Staff of the Nuclear Regulatory Commission filed a request that the. Presiding Officer issue an Order staying the effectiveness of his Initial Decision in_this proceeding (Staf f Request for a Stay) ,1 pending-the Presiding Officer's review and consideration of the staff's Motion for Reconsideration filed simultaneously.

Because a Motion for Reconsideration has been filed, the Presiding Officer retains jurisdiction. See 10 C.F.R. S 2.771.

ORDER For all the foregoing reasons and upon consideration of the-entire record in this matter, it is this 12th day of March, 1997, ORDERED, that:

1. The effect of the Initial Decision issued by the Presiding Officer on February 28, 1997, is postponed until March 21.

2. Mr. Ralph L. Tetrick may file his response to the Staff's Request for Issuance of a Stay, March 10, 1997.

Mr. Tetrick's response must be served so .that all required copies will be received by the close of business on Tuesday,
