NRC STAFF MOTION FOR EXTENSION OF TIME _

o, I. INTRODUCTION On July 7,1990, the Atomic Safety and Licensing Board designated to preside over the above-captioned proceeding issued an order which requires a response to be filed by the Staff by August 14,-1990. Memorandum and Order (Motion to Dismiss).

Pursuant to 10 C.F.R. Q 2.711 of the Commission's regulations, the Staff moves the

-Licensing Board for an order extending the time for the Staff to file its response until August 31,1990. Staff counsel has contacted counsel for Applicant, Florida Power and Light Company. Applicant's counsel had no objection to this motion, provided that the Applicant receives an extension of time until ten business days after the filing of the Staff's response. In the original order, the Applicant was given ten business days to comment on the Staff's filing. !

II. ARGUMENT After receipt of the Licensing Board's order of July 17, 1990, the Staff factored Since NEAP has been dismissed as a party to this proceeding, the Staff did not discuss this motion with counsel for NEAP.

2-the issues raised in the Ucensing Board's request into its review of the License Amendment which is the subject of this proceeding. Thus, the technical information relating to those issues will be contained in the Safety Evaluation accompanying the amendment. Due to the size of the amendment, the Staff has determined that it would

- be extremely difficult to complete all of the mechanical processes attendant upon the issuance of a License amendment by August 14, 1990, the date on which the staff's

- response must be filed with the Licensing Board. These activities include the compilation, reproduction, quality control and distribution of the amendment and its supporting documents. Therefore, the Staff is requesting an extension of time to file its response until August 31,1990. ' This extension will allow the Staff to complete all of these activities. The staff will make every attempt to issue the amendment and complete >

its response to the Licensing Board prior to the extended deadline.

III. CONCLUSION For the reasons set forth above, and for good cause shown, the Staff moves the~

Licensing Board, pursuant to 10 C.F.R. ! 2.711 of the Commission's regulations, for an

- extension of time until August 31,1990, for the Staff to file its response to the Licensing Board's order of July 17,'1990. As noted above,- the Applicant does not object to this extension.
