LICENSEE's NOTION FOR LEAVE To munu1T cITATInu To auPPLEMENTAL AUTHORITY On April 3, 1990, Licensee submitted its brief in this proceeding.
Subsequently, on June 27, 1990, the Supreme Court decided Luian v. National Wildlife Faderation, No.89-640, 58 L.W. 5077, June 26, 1990.
At slip opinion 14-15, 58 L.W. 5081-82, the majority opinion enunciates principles governing rulings on motions for summary judgment under Rule 56 of the Federal Rules of Civil Procedure in circumstances in which the opposition is supported by affidavits that contain factual ambiguities.
The discussion bears directly upon the argument made at pages 34-36 of Licensee's Brief and pages 16-17 of Intervonors' Brief.
