07 April 3, 1990, Licensee submitted its brief in this proceeding.
Subsequently, on June 27, 1990, the Supreme Court
-decided Luian v. National Wildlife Federation, No.89-640, 58 L.W. 5077, June 26, 1990.
At slip opinion 14-15, 58 L.W.
5081-i 82, the majority opinion enunciates principles governing rulings on motions for summary judgment under Rule 56 of the Federal Rules of Civil Procedure in circumstances in which the opposition
-is supported by affidavits that contain factual ambiguities.
The l-discussion bears directly upon the argument made at pages 34-36
-of Licensee's Brief and pages 16-17 of Intervenors' Brief.
Consequently, and in accordance with the procedure prescribed in
