Dear Mr. Burstein:

On November 19, 1980 the Commission published a revised Section 10 CFR 50.48 and a new Appendix R to 10 CFR 50 regarding fire protection features of nuclear power plants. On November 24, 1980 we sent a letter to all power reactor licensees with plants licensed prior to January 1,1979 outlining the provisions of the new rule that were applicable to their respective facilities. to that letter listed a sumary of staff requirements to resolve open items at Point Beach 1 & 2 as they related to the new rule.

Our review of certain of these items, referenced in your October 13, 1980 response to our request for additional information was not yet complete.

Based on our review of your letter of October 13, 1980, we conclude that your proposed modification regarding item 3.1.29 is acceptable and this item is, therefore, resolved.

The resolution of this item is discussed in the enclosed Fire Protection Safety Evaluation Report (SER) Supplement (Enclosure 1).

We also conclude that your proposed modification for item 3.1.15 does not adequately address our concerns as related to Section III, Paragraph G of Appendix R to 10 CFR Part 50.48 and, therefore, remains an open item. A discussion of this item is contained in Enclosure 2.

A summary of the status of the Point Beach Fire Protection review status is also provided in Enclosure 3.
