SHINE MEDICAL TECHNOLOGIES, INC. - ACKNOWLEDGMENT OF RECEIPT OF ANNUAL FINANCIAL REPORT (EPID NO. L-2017-PMP-0014)

Dear Dr. Piefer:

By letter dated May 11, 2017 (Agencywide Documents Access and Management System Accession No. ML17135A337), SHINE Medical Technologies, Inc. (SHINE) submitted to the U.S. Nuclear Regulatory Commission (NRC or Commission) its annual financial report, including certified financial statements, in accordance with the requirements of Title 10 of the Code of Federal Regulations (10 CFR) 50.71, Maintenance of records, making of reports, paragraph (b).

Pursuant to 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities, the NRC considers the financial qualifications of applicants and licensees during the initial licensing reviews of construction permit and operating license applications. Once a construction permit or operating license has been issued, the NRC requires certain permit holders and certain licensees to submit their annual financial reports, in accordance with 10 CFR 50.71(b). While these annual financial reports are submitted for informational purposes, the NRC keeps these reports available for inspection when considering a permit holders or a licensees financial qualifications to conduct activities authorized under its 10 CFR Part 50 construction permit or operating license.

The NRC issued Construction Permit No. CPMIF-001 on February 29, 2016, finding, in part, that SHINE was financially qualified to design and construct its proposed medical isotope facility in accordance with the Commissions regulations set forth in 10 CFR Chapter I based on the information provided in SHINEs preliminary safety analysis report supporting its construction permit application. As of the writing of this letter, SHINE has neither initiated construction of its proposed facility nor has it submitted any additional design information as part of an operating license application for NRC review under Docket No. 50-608.

Therefore, based upon the status of activities authorized under Construction Permit No. CPMIF-001 and the status of applications submitted under Docket No. 50-608, the NRC has determined that no action is necessary on SHINEs annual financial report at this time.

However, pursuant to 10 CFR 50.33, Contents of applications; general information, paragraph (f)(5), the Commission may request that SHINE submit additional or more detailed information respecting its financial arrangements and status of funds if the Commission considers this information appropriate.
