PROPOSED INPOSITION OF CIVIL PENALTIES - $75,000 9-.s This is to inform the CorrImission that a Notice of Violation and Proposea Imposition of Civil Penalties in the accumulative amount of Seventy-Five Thousand Dollars ($75,000) will be issued on or about July 5, 1989 to Pacific Gas and Electric Company.

This action is based on violations in two areas of concern.

In the first,'arious violations involving engineering and design control were identified which resulted in, among other things, having less than the required number of auxiliary feedwater pumps.

In the second, the licensee failed to take corrective actions for identified conditions adverse tc quality.

The escalation and mitigation factors were considered and for the first problem 50 percent mitigation of the base civil penalty was deemed appropriate for the licensee's corrective actions.

In the case of the second problem mitigation for corrective actions was offset by escalation for past poor performance.

It shoula be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of Notice Telephone Notification of Licensee The State of California will be notified.

July 5, 1989 July 5, 1989 The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
