Dear Mr. Diya:

By letter dated March 12, 2012 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML12054A735), the U.S. Nuclear Regulatory Commission (NRC) ordered Union Electric Company, doing business as Ameren Missouri (UE, the licensee), to take certain actions at Callaway Plant, Unit 1 (Callaway), associated with the Fukushima Near-Term Task Force Recommendations. Order EA-12-049 directed that actions be taken by licensees to develop and implement strategies to maintain or restore core cooling, reactor coolant system inventory, containment cooling, and spent fuel pool cooling capabilities during beyond design basis external events. The compliance date for Callaway's full implementation of the requirements contained in Order EA-12-049, as specified in the NRC's letter dated December 11, 2013 (ADAMS Accession No. ML13319A668), is the completion of the spring 2016 refueling outage.

By letter dated August 1, 2014 (ADAMS Accession No. ML14217A236), UE submitted a relaxation request regarding NRC Order EA-12-049. The rationale for submitting the relaxation request relates to the proposed use of NRC Regulatory Guide (RG) 1. 76, "Design-Basis Tornado and Tornado Missiles for Nuclear Power Plants," Revision 1 (ADAMS Accession No. ML070360253), for the design of a new hardened Condensate Storage Tank (CST), as well as a new storage building for housing equipment used in the Callaway Order EA 12-049 compliance strategy. Based on discussions with the NRC staff, UE retracted the relaxation request by letter dated February 18, 2015 (ADAMS Accession No. ML15049A364). The retraction letter acknowledged that the use of RG 1. 76, Revision 1, for Callaway should be treated as an alternative to Nuclear Energy Institute (NEI) 12-06, "Diverse and Flexible Coping Strategies (FLEX) Implementation Guide" (ADAMS Accession No. ML12242A378), and thus does not require an order relaxation request. By letter dated August 28, 2014 (ADAMS Accession No. ML14241A664), UE documented the proposed use of RG 1.76, Revision 1, for the design of the new hardened CST and FLEX storage building in its third six-month status report, submitted in response to Order EA-12-049.

F. Diya The purpose of this letter is to advise that the above-cited request for relaxation from NRC Order EA-12-049 is being treated as withdrawn. The NRC review of the proposed NEI 12-06 alternative will be performed in conjunction with the mitigating strategies audit process (ADAMS Accession No. ML13234A503).
