M.Mulligan 2.206 Petition Re: Pilgrim Nuclear Plant SRVs Mr. Mulligan, The PRB met on May 6, 2013, to make an initial recommendation on your petition dated Mar 7, 2013 (ADAMS Accession No. ML13070A055) as supplemented on Mar 20, 2013 (ML13098A077) and April 5, 2013 (ML13098A091). The PRBs decision is to reject your petition on the grounds that your petition request either does not meet the criteria for review or meets the criteria for rejection in accordance with the guidance provided in Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions.

As support for the PRBs initial recommendation, the licensees operability evaluations for the SRVs that have leaked at Pilgrim have been reviewed by the NRC inspectors and determined to be adequately justified. The NRC staff has also determined that the licensee is in compliance with the applicable Technical Specifications and have demonstrated that SRVs are monitored and maintained in a condition that ensures they will perform their safety functions. The NRC staff continues to monitor and collect operating experience on SRV leakage problems; the NRC is also aware that the industry has seen and is investigating leaking SRVs of this specific design. However, neither the NRC staff's evaluations nor industry operational data to date, indicates that the specific SRV model or design at Pilgrim poses a risk-significant safety concern.

As you requested, your petition and supplemental information have been forwarded to the Office of the Inspector General (OIG). Your April 11, 2013, presentation to the PRB was made a publicly available transcript and official agency record (ADAMS Accession No. ML13112B055) and was also forwarded to the OIG.

In accordance with the 10 CFR 2.206 process, the PRB is offering you a 2nd opportunity to comment on the PRB recommendation and provide any relevant additional explanation and support for your petition request in light of the PRBs recommendations. Please let me know if you would like to have a 2nd meeting/teleconference; and I will coordinate with you and the PRB to work out a mutually agreeable date/time.
