Enclosed for your information is the synopsis of the Nuclear Regulatory Commissions (NRC)

Office of Investigations (OI) completed supplemental report regarding alleged discrimination, by the South Carolina Electric & Gas Company against an employee who filed a complaint with the U.S. Department of Labor.

OI was unable to substantiate the allegation that a process analyst was the subject of employment discrimination for engaging in protected activity. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). SYNOPSIS The U.S. Nuclear Regulatory Commission (NRC), Office of Investigations, Region IL, initiated this supplemental investigation on January 14, 2002, to determine whether South Carolina Electric and Gas Company, an NRC licensee, discriminated against a Virgil C. Summer Nuclear Station process analyst for engaging in protected activity.

Based upon evidence, documentation, and testimony developed during this investigation, the allegation that a process analyst was the subject of employment discrimination for engaging in protected activity was not substantiated.
