RIVER BEND STATION - FINAL SIGNIFICANCE DETERMINATION FOR A SECURITY-RELATED GREATER THAN GREEN FINDING; NRC INSPECTION REPORT 05000458/2014406

Dear Mr. Olson:

This letter provides the final results of our significance determination of the preliminary Greater-than-Green finding identified in NRC Inspection Report 05000458/2014405 dated July 16, 2014.

A detailed description of the finding is contained in Section 3.9 of that report.

In a letter, dated August 14, 2014, (ML14234A120), you provided a response to the NRC staff's preliminary determination regarding this finding. Your response included your agreement that the finding has greater than very low security significance and is, therefore, appropriately characterized as Greater-than-Green. After considering the information developed during the inspection and the additional information you provided in your letter, the NRC has concluded that the finding is appropriately characterized as Greater-than-Green with greater than very low security significance.

Because performance at the River Bend Station is outside the Licensee Response Column of the NRCs Reactor Oversight Process (ROP) Action Matrix as a result of the Greater-than-Green significance of the subject finding, the NRC will use the ROP Action Matrix to determine the most appropriate NRC response to the findings significance. We will notify you, by separate correspondence, of that determination.

In addition, the NRC is still considering whether any apparent violation(s) are associated with the finding, in accordance with the NRC Enforcement Policy. Upon reaching a determination in this matter, enforcement-related information will be communicated by separate correspondence at a later date. In accordance with 10 CFR 2.390 of the NRC's Rules of Practice and Procedure, a copy of this letter will be made available electronically for public inspection in the NRC Public Document Room or in the NRCs Agencywide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

However, the material enclosed herewith contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or in ADAMS. If you choose to provide a response, and Security-Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). If Safeguards Information is necessary to provide an acceptable response, please provide the level of protection described in 10 CFR 73.21. In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
