RIVER BEND STATION - NOTIFICATION OF NRC FOLLOW-UP INSPECTION FOR ONE SEVERITY LEVEL (SL) III AND TWO SL IV OR THREE OR MORE SL IV VIOLATIONS WHEN ALL OCCUR WITHIN A SINGLE TRADITIONAL ENFORCEMENT AREA OF WILLFULNESS, IMPEDING THE REGULATORY PROCESS, OR ACTUAL CONSEQUENCE DURING ANY 12-MONTH PERIOD (92723) AND REQUEST FOR INFORMATION
Dear Phil Hansett:
By letter dated August 31, 2023, (ADAMS ML23229A568), the U.S. Nuclear Regulatory Commission (NRC) communicated to you that the Regional Administrator has authorized an additional non-baseline inspection using Inspection Procedure 92723, Follow up Inspection for Three or More Severity Level IV Traditional Enforcement Violations in the Same Area in a 12-Month Period. Since the issuance of that letter additional Severity Level IV violations have occurred. The violations to be scoped under this inspection include: (A) the failure to ensure that all components required to achieve safe shutdown by 10 CFR 50, appendix R, were listed as such in the updated safety analysis report; (B) a failure to obtain prior approval for a change which adversely affected the approved Fire Protection Program; (C) a change to the required operability time of the automatic depressurization system as specified in the updated safety analysis report from 100 days to 30 days without agency approval; (D) the failure to ensure that the design capacity of the high pressure core spray diesel generator air start system was updated to reflect a change to the diesel engine start time requirement; (E) the failure to obtain a license amendment prior to implementing a proposed change associated with the standby liquid control tank level instrument; (F) a failure to perform an adequate 10 CFR 50.59 evaluation and obtain a license amendment prior to implementing change package 2000-11; (G) a failure to ensure that the design capacity of the diesel generator air start system was updated to reflect a change to the diesel engine air start capacity and start time requirements; and (H) a Notice of Violation for the failure to obtain a license amendment for a change to the licensing basis for the ultimate heat sink that required prior NRC approval.
By letters dated December 7, 2023 (ML23341A031) and July 31, 2024 (ML24213A199), we were notified by your staff of Entergys readiness for the NRC to conduct a follow-up inspection to review the actions taken to address the multiple SLIV violations. Accordingly, we plan to conduct a follow-up inspection, beginning on October 7, 2024, at River Bend Station, Unit 1 using Inspection Procedure 92723, Follow-up for one Severity Level (SL) III and two SL IV or three or more SL IV violations when all occur within a single traditional enforcement area of

willfulness, impeding the regulatory process, or actual consequence during any 12-month period. This on-site inspection is scheduled to be performed October 7, 2024, through October 11, 2024.
In order to minimize the impact to your on-site resources and to ensure a productive inspection for both organizations, we have enclosed a request for documents needed for this inspection.
The documents identified are those the inspectors will need prior to and upon their arrival on site. It is important that all the documents are up-to-date and complete in order to minimize the number of additional documents requested during the on-site portion of the inspection.
To the extent possible, please organize the information as specified in the RFI. Experience has shown that poorly organized files can lead to a less efficient inspection and places additional burden on licensee staff. Secure file server access such as Certrec or SharePoint is preferred.
During the inspection, the inspectors may request additional documents. If there are questions regarding the documents or material requested, or if the documents cannot be provided by the due date, please do not hesitate to contact the lead inspector Christopher Highley at (240) 704-4264. We have discussed the schedule for these inspection activities with your staff and understand that our regulatory contact for this inspection will be Hayley Kunzli of your organization.
This letter does not contain new or amended information collection requirements subject to the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.). Existing information collection requirements were approved by the Office of Management and Budget, under Control Number 3150-0011. The NRC may not conduct or sponsor, and a person is not required to respond to, a request for information or an information collection requirement unless the requesting document displays a currently valid Office of Management and Budget control number.
In accordance with Title 10 of the Code of Federal Regulations 2.390, Public Inspections, Exemptions, Requests for Withholding, of the NRC's "Rules of Practice," a copy of this letter, its enclosure, and your response (if any) will be available electronically for public inspection in the NRCs Public Document Room or from the Publicly Available Records System (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS).
