SUBJECT:

NOTICE OF VIOLATION (NRC INSPECTION REPORT 50-369/97-16 AND 50-370/97-16)

Dear Mr. Barron:

This refers to the special inspection conducted on July 12 - August 27, 1997.

at the McGuire facility. The )urpose of the inspection was to review the circumstances and conditions tlat resulted in a number of the Unit 2 ice ccndenser lower inlet doors being declared inoperable and to evaluate your corrective actions for this aroblem. The results of the inspection were formally transmitted to you ay letter dated September 16, 1997. An open.

3redecisional enforcement conference was conducted in the Region-II office on October 1.1997, with you and members of your staff to discuss the apparent violations, the root causes, and corrective actions to preclude recurrence. A list'of conference attendees. NRC slides, and a copy of your presentation materials are enclosed.

Bastd on the information developed during the ins)ection and the information that was provided during the conference, the NRC 1as determined that a violation of NRC requirements occurred. - The violation (previously identified as apparent violation 50-370/97-16-01) is cited in the enclosed Notice of

,

Violation (Notice), and the circumstances surrounding it are described in detail in the subject-inspection report.

This violation, which has been categorized at Severity Level IV. involved a failure to comply with Technical--

,

I Specification requirements for -the operability of the ice condenser inlet

. doors on Unit 2 for a period of time between May 1996 (completion of the end-of-cycle 10 refueling outage) and July 11. 1997 (low reactor coolant system flow trip), during operation in Modes 1. 2. 3. and 4.

Specifically, on July 17. 1997, with Unit 2 in Mode 5 for a forced reactor coolant pump motor replacement outage.10 of 48 lower ice condenser inlet doors were discovered to be inoperable (i.e., incapable of opening at a torque less than or equal to that s)ecified-in the Technical Specifications).

Your investigation revealed-that t1e affected doors were binding due to floor heave caused-by water intrusion and subsequent freezing. The NRC recognizes that the violation was identified as-the result of a non-scheduled surveillance test that was prompted by the questioning attitude of your staff.

However, we are concerned-

,

that had the problem been identified at a later date, the capability of the Unit 2 ice condenser to perform its safety-related function could have been-severely impacted.

The subject inspection report also identified an apparent violation (50-370/97-16-02) regarding the failure to perform adequate corrective actions in accordance with 10 CFR Part 50 Appendix B Criterion XVI to preclude door inoperability from binding due to floor heave caused by water intrusion and subsequent freezing.

The apparent violation was based upon inspection findings that you may not have adequately utilized previous

. McGuire or industry events in your-corrective actions. At the predecisional

,

enforcement conference, you expressed disagreement with this apparent violation, indicating that actions implemented at McGuire in response to

!

relevant industry experience were appropriate under the circumstances.

Based on the information you presented during the predecisional enforcement

,

conference. NRC has determined that your actions were reasonable with respect

!

to available industry information: therefore.-this apparent-violation is withdrawn.

You are required to respond to this letter and should follow the instructions s)ecified in 'he enclosed-Notice when preparing your response. -Your response s1ould address those actions taken and planned to prevent recurrence.

-including those actions to be implemented following any potential ice condenser water intrusion events in the future.

The NRC will use your response, in part. to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.
