This refers to the routine safety inspection (No. 82-02) conducted by Mr. N.
J. Blumberg of this office on January 11-15, 1982, and the special safeguards inspection (No. 82-03) conducted by Mr. R. J. Bailey of this office on January 26-29, 1982, at Pilgrim Nuclear Power Station, Unit 1, Plymouth, Massachusetts of activities authorized by NRC License No. CPR-35 and to the discussions of our findings held by Mr. Blumberg with Messrs. W. Harrington and R. Machon on January 15, 1982, and by Mr. Bailey with C. Mathis on January 29, 1982.
Areas examined during these inspections are described in the NRC Region I Inspection Reports which are enclosed with this letter.
Within these areas, the inspections consisted of selective examinations of procedures and represent-ative records, interviews with personnel, and observations by the inspectors.
During the routine safety inspection (No. 82-02), our inspector also verified the steps you have taken to correct the item of noncompliance brought to your attention in the enclosure to our letter dated October 7, 19S0 (Item B) and the item of noncompliance brought to your attention in a letter dated March 26, 1981 (Item A).
We have no further questions regarding the steps you took to correct Item B.
With regard to Item A, this item was not fully corrected.
Based on the results of the routine safety inspection, (82-02), it appears that certain of your activities were not conducted in full compliance with NRC requirements as set forth in the Notices of Violation, enclosed herewith as Appendices A and B.
These violations have been categorized by Severity level in accordance with the NRC Enforcement Policy (10 CFR 2, Appendix C) published in the Federal Register Notice (47 FR 9987) dated March 9, 1982.
You are required to respond to this letter and in preparing your response, you should follow the instructions in Appendices A and B.
The item described in the attached Notice of Violation, Appendix B, involving security access control requirements, is classified as a Severity Level IV violation. As indicated in Supplement III of the NRC Enforcement Policy (10 0FFICIAL RECORD COPY A20517o303 ENCLOSURE CONTAINSK.

However, after careful consideration of the factors involved in this instance including the fact that numerous authorized individuals were in the three uncontrolled areas, and that a degree of security coverage of these three areas did exist, we have exercised our judgement under the NRC Enforcement Policy and have classified this violation as Severity Level IV.
Similar violations of this type in the future may result in additional enforcement action.

In accordance with 10 CFR 73.21 of the NRC's regulations, documentation of security measures for the physical protection of special nuclear materials and certain plant equipment vital to the safety of production or utilization facilities are deemed to be Safeguards Information.
Each person who produces, receives or acquires Safeguards Information is required to ensure that it is protected against unauthorized disclosure.
Therefore, pertinent sections of Inspection Report No. 82-02, the entire Inspection Report 82-03, Appendix B, and your response to the item identified in Appendix B will not be placed in the Public Document Room and will receive limited distribution.
In accordance with 10 CFR 2.790(a), a copy of this letter, the cover sheets to the two reports, pertinent sections of Inspection Report No. 82-02, Appendix A, and your response to the items identified in Appendix A will be placed in the NRC Public Document Room unless you notify this office, by telephone, within ten days of the date of this letter and submit written application to withhold information contained therein within thirty days of the date of this letter. Such application must be consistent with the requirements of 2.790(b)(1).
The responses directed by this letter and the accompanying Notices are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
