Results: One apparent item of noncompliance was identified (the transfer of byproduct material in a form the recipient was not authorized to receive).

DETAILS On July 17, 1981, the Boston Edison Company dispatched a shipment of LSA radioactive waste (solid metallic oxides on gravel and trash) to the Chem-Nuclear Systems, Inc. burial site at Barnwell, South Carolina according to a licensee representative.

The shipment was made in twelve 55 gallon drums and eighteen crates containing 0.134 curies.

On July 20, 1981, a representative of the South Carolina Department of Health and Environmental Control inspected the shipment at the burial site. The inspection consisted of a review of shipping papers, placarding, marking and labeling, radiation measurements, selective contamination surveys and examination of the packages and the tractor-trailer.

A copy of the report, without attachments, prepared by the representative is attached.

The report states that the twelve drums were opened, and ten of the drums were found to contain free standing liquid.

Further investigation revealed that four of the ten drums contained amounts of liquid in excess of the Chem-Nuclear Systems, Inc., license limit.

Chem Nuclear Systems, Inc.'s Agreement State License for the Barnwell burial site, South Carolina Radioactive Material License No. 097, specifies, in License Condition 26, that solidified radioactive waste shall have no detectable free standing liquid.

The license condition defines "no detectable free standing liquid" as follows:

"(a) One percent (1%) liquid by waste volume until December 31, 1980.

(b) Effective January 1,1981, one-half percent (0.5%) by waste volume or one gallon of non-corrosive liquids per container, whichever is less.

In lieu of the requirements of sub paragraph (b) above, solidified waste containing liquids in excess of one-half percent (0.5%) by waste volume, but less than one percent (1%) liquid by waste volume, may be received and disposed of in approved high integrity containers."

On September 25, 1981 P. Clemons was informed by a representative of the South Carolina Department of Health and Environmental Control'that the 55 gallon drums used in this shipment were not " approved high integrity containers".

The applicable one-half percent by waste volume quantity is 0.275 gallon per drum. The amount of free standing liquid in the four drums varied from 0.5 gallons - 0.75 gallons per drum, 0.8 - 1.34 percent liquid by volume.

10 CFR 30.41 prohibits transfer of byproduct material unless it is in a form authorized by the recipient's NRC or Agreement State license. Therefore,-the-transfer of byproduct material on July 20, 1981 to Chem-Nuclear Systems, Inc.,

containing free standing liquid in excess of the Chem-Nuclear Systems, Inc.,

license limit represents noncompliance with 10 CFR 30.41.
