Inspection No. 50-272/89-17 This refers to your letter dated August 2, 1989, in response to our letter dated July 3, 198 We have reviewed the additional information you provided in response to Violation (Your letter identified this as Violation A).
Based on our discussions with your Mr. Thompson on August 15, 1989 we understand that in your opinion procedure SP (O) 4.0.5-V-SJ-6 does not require a PORC review as this procedure was generated from an existing PORC approved procedure SP(O) 4.05-V-REFUE However, your review of the incident revealed that the original procedure SP(O) 4.0.5-REFUEL should have required a 10 CFR 50.59 review as it involved a change to a test described in the FSA While we agree that violation against 10 CFR 50.59 is more appropriate for this situation, it is our position that the violation need not be rewritten since your implemented and planned corrective actions are effectively addressing all of our concerns in this regar Thank you for informing us of the corrective and preventive actions documented in your letter.
