Thank you for your responses of April 3 and May 2, 1985, to our Notice of Violation issued on March 8, 1985, concerning licensed activities conducted at your Robinson facility. We have examined your responses and found that they meet the requirements of 10 CFR 2.20 After careful consideration of the bases for your denial of the violation, we have concluded that your position with respect to Technical Specifica tion 6.5.1.1.1.c is correct and our records will be adjusted accordingl Our review has also determined that your position with respect to 10 CFR 50, Appendix B, Criterion V, is unacceptable and that this portion of the violation occurred as state We recognize that corrective action has been taken concerning minimum tempera ture criteria for satisfactory battery operation, but we are concerned about the apparent CP&L management philosophy utilized in this case to justify the violation denia In paragraph 2 of the May 2, 1985 response, a considerable effort was documented to verify that low temperatures incurred by the batteries did not reduce battery performance below the capacity to carry connected safety-related load Although this after-the-fact review does establish a history of acceptable battery performance, it does not meet the intent of 10 CFR 50, Appendix B, Criterion V, requirements to review activities affecting quality and determine quantitative acceptance criteria before performing the activit Our position is that any after-the-fact review that demonstrates that a condition adverse to quality did not exist does not necess'arily satisfy the requirement to determine acceptance criteria before an activity is performe In that your responses describe corrective actions for the battery violation, an additional response addressing this problem area is not required.
