PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3 MODIFICATION TO SUBSEQUENT RENEWED FACILITY OPERATING LICENSE NOS. DPR-44 AND DPR-56 IN CONJUNCTION WITH COMMISSION MEMORANDUM AND ORDER CLI-22-04 (EPID L-2018-RNW-0012)

Dear Mr. Rhoades:

By letter dated March 5, 2019 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20010F285), the U.S. Nuclear Regulatory Commission (NRC or the Commission) issued Subsequent Renewed Facility Operating License Nos. DPR-44 and DPR-56 to the former Exelon Generation Company, LLC, before the license transfer to Constellation Energy Generation, LLC, on February 1, 2022 (ADAMS Accession No. ML22021B660), for Peach Bottom Atomic Power Station, Unit Nos. 2 and 3 (Peach Bottom, Units 2 and 3). Subsequent Renewed Facility Operating License Nos. DPR-44 and DPR-56 for Peach Bottom, Units 2 and 3 were set to expire on August 8, 2053, and July 2, 2054, respectively.

Following the Commissions direction in the February 24, 2022, Memorandum and Order CLI-22-04 (ADAMS Accession No. ML22055A557), the NRC staff has modified the expiration dates for the subsequent renewed facility licenses to reflect the end dates of the previous renewed licenses. For Peach Bottom Units 2 and 3, the NRC staff has modified the subsequent renewed license expiration dates to August 8, 2033, and July 2, 2034, respectively. to this letter contains the modification to Subsequent Renewed Facility Operating License No. DPR-44 for Peach Bottom Unit 2. to this letter contains the modification to Subsequent Renewed Facility Operating License No. DPR-56 for Peach Bottom Unit 3.

Subsequent License Renewal of Peach Bottom Atomic Power Station, Units 2 and 3, dated February 2020, are collectively the Subsequent License Renewal UFSAR Supplement. This Supplement is henceforth part of the UFSAR, which will be updated in accordance with 10 CFR 50.71(e). As such, Exelon Generation Company may make changes to the programs, activities, and commitments described in the Subsequent License Renewal UFSAR Supplement, provided Exelon Generation Company evaluates such changes pursuant to the criteria set forth in 10 CFR 50.59, Changes, Tests, and Experiments, and otherwise complies with the requirements in that section.

(b) The Subsequent License Renewal UFSAR Supplement, as defined insubsequent renewed license condition (19)(a) above, describes programs to be implemented and activities to be completed prior to the subsequent period of extended operation, which is the period following the July 2, 2034, expiration of the initial renewed license.

1. Exelon Generation Company shall implement those new programs and enhancements to existing programs no later than 6 months before the subsequent period of extended operation.
2. Exelon Generation Company shall complete those activities by the 6-month date prior to the subsequent period of extended operation or by the end of the last refueling outage before the subsequent period of extended operation, whichever occurs later.
3. Exelon Generation Company shall notify the NRC in writing within 30 days after having accomplished item (b)1 above and include the status of those activities that have been or remain to be completed in item (b)2 above.
3. This subsequent renewed license is effective as of the date of issuance and shall expire at midnight on July 2, 2034.
