MF0537)

Dear Mr. Leib:

By letter to the U.S. Nuclear Regulatory Commission (NRC) dated January 1B, 2013 (Agency Document and Management System (ADAMS) Accession No. ML 1301 BA349), FirstEnergy Nuclear Operating Company (FENOC), submitted an exemption request for the Davis-Besse Nuclear Power Station, Unit No.1 (DBNPS). By letter dated February 2B, 2013 (Agency Document and Management System Accession No. ML 1305BA253), the NRC sent a letter to FENOC requesting supplemental information to make an acceptance review determination.

By letter dated March B, 2013 (ADAMS Accession No. ML 13070A226), FENOC submitted supplemental information which replaces the January 1B, 2013, submittal in its entirety.

The March B, 2013, letter contained a proposed alternative which would allow the use of an alternate method of containment testing following activities associated with steam generator replacement The purpose of this letter is to provide the results of the NRC staff's acceptance review of this relief request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant. Pursuant to Title 10 of the Code of Federai Regulations, Section 50.55a(a)(3)(i), the applicant shall demonstrate that the proposed alternatives would provide an acceptable level of quality and safety. The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.

Given the lesser scope and depth of the acceptance review as compared to the R Leib -detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.
