ACKNOWLEDGEMENT OF ANNUAL RESPONSE TO CONFIRMATORY ORDER EA-13-068
Dear Mr. Hanson:
This acknowledges the receipt of your letter dated October 28, 2015, which provided an update to the status of your actions to complete the requirements contained in Confirmatory Order EA-13-068, as required by Section V.C of the Confirmatory Order. The Confirmatory Order confirmed commitments made by Exelon Generation Company, LLC (EGC) to the U.S. Nuclear Regulatory Commission (NRC) in an Alternate Dispute Resolution session. On May 4, 2015, the Confirmatory Order was relaxed by the NRC to allow EGC until November 30, 2015, to meet the requirements of Condition V.A.1. The NRC also relaxed the completion dates of Conditions V.A.2 and V.A.3. We understand from your letter that you are completing the final reviews of the revision to the Behavioral Observation Program procedure, as required by Condition V.A.1. In your letter, you also confirmed that Conditions V.A.2 and V.A.3 would be completed by the dates provided in the relaxation. Once you have notified us that all actions have been completed, we will schedule and conduct a follow-up inspection. The purpose of the inspection will be to independently confirm completion of the actions and evaluate their effectiveness in resolving the issues specified in the Confirmatory Order. In accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, "Public Inspections, Exemptions, Requests for Withholding," of the NRC's "Rules of Practice," a copy of this letter, and your response (if any) will be available electronically for public inspection in the NRC's Public Document Room or from the Publicly Available Records (PARS) component of the NRC's Agencywide Documents Access and Management System (ADAMS).
