DRESDEN NUCLEAR POWER STATION, UNIT 1 - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE RE:

ALTERNATIVE SCHEDULE TO COMPLETE DECOMMISSIONING BEYOND 60-YEARS OF PERMANENT CESSATION OF OPERATIONS (EPID: L-2024-LLE-0012)

Dear Mark Humphrey:

By letter dated March 14, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24074A436), Constellation Energy Generation, LLC (CEG) submitted a request to the U.S. Nuclear Regulatory Commission (NRC) for review of a proposed request to allow the completion of decommissioning for Dresden Nuclear Power Station, Unit 1 (Dresden Unit 1) beyond 60 years of permanent cessation of operations.

The submittal requested that the information contained in Attachment 1 be withheld from public disclosure pursuant to Section 2.390(d)(1) of Title 10 of the Code of Federal Regulations (10 CFR) because it contains Sensitive Unclassified Non-Safeguards Information (SUNSI) documentation.

We have reviewed your application and the supporting information in accordance with the requirements of 10 CFR 2.390 and have concluded that you have not provided sufficient justification for us to determine that Attachment 1 should be withheld from public disclosure.

Specifically, a substantial amount of the portion-marked information is regulatory information that is publicly available for the operation or decommissioning of a nuclear power reactor, or is contained in the licensees public Updated Final Safety Analysis Report (UFSAR), Revision 15 (ML23180A022) and Defueled Safety Analysis Report Update, Revision 6 (ML12173A424).

Accordingly, we have concluded that the information sought to be withheld from public disclosure does not meet the requirements of 10 CFR 2.390, and your request to withhold, Supplemental Information for Decommissioning Impact on Public Health and Safety for Dresden Nuclear Power Station, Unit 1, in association with your Request for Alternative Schedule to Complete Decommissioning Beyond 60 Years of Permanent Cessation of Operations from public disclosure is denied.

At this time the information remains non-public; however, the subject document will be placed in the NRCs Public Document Room within 10 days of the date of this letter unless you provide information to justify withholding the documents in accordance with 10 CFR 2.390(c), in which July 24, 2024 case your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Website at http://www.nrc.gov/reading-rm/adams.html.
