Mark D. Humphrey Senior Manager - Licensing Constellation Energy Generation, LLC 4300 Winfield Road Warrenville, IL 60555

SUBJECT:

DRESDEN NUCLEAR POWER STATION, UNIT NO. 1 - SUPPLEMENTAL INFORMATION NEEDED FOR ACCEPTANCE REVIEW OF REQUESTED LICENSING ACTION RE: ALTERNATIVE SCHEDULE TO COMPLETE DECOMMISSIONING BEYOND 60-YEARS OF PERMANENT CESSATION OF OPERATIONS (EPID: L-2024-LLE-0012)

Dear Mark Humphrey:

By letter dated March 14, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24074A436), Constellation Energy Generation, LLC (CEG) submitted a request to the U.S. Nuclear Regulatory Commission (NRC) for review of a proposed request to allow the completion of decommissioning for Dresden Nuclear Power Station, Unit 1 (Dresden Unit 1) beyond 60 years of permanent cessation of operations. The NRC staff performed an acceptance review of your application to determine if it contains sufficient technical information to allow the staff to complete the detailed technical review and to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The purpose of this letter is to advise you, based on the NRC staffs acceptance review, that the application does not contain sufficient technical information to allow the NRC staff to complete its detailed technical review. The information needed to continue the NRC staffs review is described in the enclosure of this letter as a Request for Supplemental Information (RSI). The RSI generally fall into requesting information with the proposed changes that would allow Dresden Unit 1 an alternate decommissioning schedule. With the recent audit at Peach Bottom Atomic Power Station, Unit 1 the NRC staff has learned there are many other factors in evaluating Dresden Unit 1 for an alternate decommissioning schedule beyond 60 years of permanent cessation of operation. Thus, a holistic understanding and assessment of the general information affecting a licensees capability to carry out decommissioning at Dresden Unit 1, including safety and risk insights unique to the site, which are needed for the NRC staff to make its determination on whether or not to accept this application.

The NRC staff requests that CEG supplement the application to address the information requested in the enclosure within 28 calendar days from this letters date. This will enable the NRC staff to begin its detailed technical review. If the information responsive to the NRC staffs request is not received by the above date, the application will not be accepted for review pursuant to 10 CFR 2.101, and the NRC will cease its activities associated with the application.

If the NRC staff accepts the application for review based on supplemental information, CEG will be advised of the review schedule by separate correspondence.

June 11, 2024

M. Humphrey The CEG has the option to withdraw its application pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 2.107, Withdrawal of application, and resubmit its application to address the deficiencies. If CEG elects this option, the NRC requests a written response dated no later than 30 calendar days from the date of this letter documenting CEGs decision, including the date that it expects to resubmit a new amendment application. Please note that an acceptance review will be conducted for future submittals (supplement to address the enclosure or resubmitted application).

In accordance with 10 CFR Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC website at: http://www.nrc.gov/reading-rm/adams.html.

If you have any questions, please contact the Dresden Unit 1, Project Manager, Tanya E. Hood, at (301) 415-1387.

Sincerely, Nicole S. Warnek, Acting Chief, Reactor Decommissioning Branch Division of Decommissioning, Uranium Recovery, and Waste Programs, Office of Nuclear Material Safety and Safeguards.
