Subject:

Response to NRC Inspection Report and Preliminary White Finding

Reference:

Letter from D. Collins (U.S. NRC Region I) to D. Rhoades (Constellation Energy Generation, LLC), "Calvert Cliffs Nuclear Power Plant, Units 1 and 2 - Integrated Inspection Report 05000317 /2022003 and 05000318/2022003 and Preliminary White Finding and Apparent Violation," dated November 7, 2022

In the referenced letter, the NRC documented a preliminary White finding related to an event involving foreign material in the 1A emergency diesel generator which occurred in February 2022.

Constellation Energy Generation, LLC (CEG) acknowledges the description surrounding the event discussed in the referenced letter.

The referenced letter requested verbal or written notification within 10 days of the date of the letter regarding CEG's intention to (1) request a regulatory conference to present to the NRC CE G's perspective on the facts and assumptions used to arrive at the finding and assess its significance, or (2) submit CEG's position on the finding to the NRC in writing.

On November 14, 2022, Peter Moodie (Plant Manager) verbally notified NRC's Brice Bickett of CEG 's decision to not contest the violation or significance of the violation. This letter confirms that CEG is not requesting a regulatory conference on this matter and will not be submitting a written response. It is understood by CEG that by declining to submit a written response or to arrange a regulatory conference, the preliminary assessment of significance will become final.

There are no regulatory commitments contained in this letter. Should you have any questions regarding this matter, please contact Mr. Larry D. Smith at (410) 495-5219.
