MEMORANDUM AND ORDER (Granting Motion for Extension of Time)

On December 15, 2023, Miami Waterkeeper filed a motion seeking a ten-day extension,

from Friday, December 29, 2023, to Monday, January 8, 2024, to reply to the Nuclear

Regulatory Commission (NRC) Staffs and Florid a Power & Light Companys (FPL) answers to

its hearing request.1 FPL opposes Miami Waterkeepers motion. 2

Miami Waterkeeper asserts, among other things, that the ten-day extension is warranted

because its office will be closed from December 22 to 25, 2023, and again on January 1, 2024,

and the majority of project staff will be unavailable until January 5, 2024. For good cause

shown, we grant Miami Waterkeepers motion. 3 Miami Waterkeepers reply is now due on or

before January 8, 2024. In granting this extension, however, we remind the petitioner that a

reply should be narrowly focused on the legal or logical arguments presented in the

[answers].4

In our December 6, 2023 initial prehearing order, we stated we would await full briefing

to determine whether to hold oral argument. 5 We now advise the participants that the Boards

law clerk will reach out in the near future to discuss availability for oral argument during the

week of January 22, 2024.
