REQUEST FOR FEDERAL EMERGENCY MANAGEMENT AGENCY CONSULTATION ON THE DOMINION ENERGY PROPOSAL TO CONSOLIDATE THE EMERGENCY OPERATIONS FACILITY FOR THE VIRGIL C. SUMMER NUCLEAR STATION UNIT 1

Dear Mr. Warnock:

By letter dated June 8, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23159A233), Dominion Energy South Carolina (DESC) requested U.S. Nuclear Regulatory Commission (NRC, the Commission) approval of a proposed license amendment for the Virgil C. Summer Nuclear Station (VCSNS) Unit 1 Emergency Plan.

DESC proposes to replace the existing VCSNS near-site Emergency Operations Facility (EOF),

and the Joint Information Center from Ballentine, South Carolina and West Columbia, South Carolina, respectively, to the Dominion Energy Corporate Emergency Response Center in Glen Allen, Virginia.

The straight-line distance between the proposed EOF and the VCSNS Technical Support Center is approximately 312 miles. Since the proposed EOF is located more than 25 miles from VCSNS, prior Commission approval is required per paragraph IV.8.b to Appendix E of Part 50, Emergency Planning and Preparedness for Production and Utilization Facilities, to Title 10 of the Code of Federal Regulations (10 CFR).

State of South Carolina, Emergency Management Division, Fairfield County Emergency Management, Lexington County Emergency Management, Newberry County Emergency Management, and Richland County Emergency Management.

T. Warnock 2 Per the Memorandum of Understanding Between the Department of Homeland Security /

Federal Emergency Management Agency (FEMA) and NRC Regarding Radiological Response, Planning and Preparedness, dated December 7, 2015 (ML15344A371), FEMA has responsibility for determining the adequacy of offsite radiological emergency plans and preparedness and providing its findings to the NRC. As such, I am requesting FEMAs concurrence that the replacement of the existing VCSNS near-site EOF with a consolidated EOF does not have an unintended impact on offsite radiological emergency preparedness plans by no later than August 18, 2023. Please contact me at your earliest opportunity if FEMA will not be able to meet this requested date for a response.
