LICENSE AMENDMENT 44 - APPROVAL OF REVISED LICENSE APPLICATION CHAPTER 10, DECOMMISSIONING (ENTERPRISE PROJECT IDENTIFIER L-2022-DFA-0007)

Dear Richard J. Freudenberger:

In accordance with your request dated August 5, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML22224A178), and pursuant to Part 70 of Title 10 of the Code of Federal Regulations (10 CFR), Materials License SNM-42 is hereby amended to approve the updated financial assurance documents and the revision to Chapter 10, Decommissioning, of the BWXT Nuclear Operations Group, Inc. - Lynchburg, VA (BWXT NOG-L) license application. The review of the U.S. Nuclear Regulatory Commission (NRC) staff is documented in the enclosed safety evaluation report. Accordingly, Safety Condition S-1 of Materials License SNM-42 has been revised to reflect the approved revision of Chapter 10 of the BWXT NOG-L license application, which was dated August 4, 2022. This letter concludes action on this application and Enterprise Project Identifier L-2022-DFA-0007 is considered CLOSED.

All other license conditions shall remain the same. The enclosures to this letter provide the amended Materials License SNM-42 and the safety evaluation report from the review of the updated financial assurance documents and the August 4, 2022, revision to Chapter 10 of the BWXT NOG-L license application. contains sensitive security-related information. Accordingly, it is marked as Official Use Only, and is withheld from public disclosure. When separated from Enclosure 2, this letter and enclosures 1 and 3 are decontrolled and publicly available, in accordance with 10 CFR 2.390 of the NRCs "Agency Rules of Practice and Procedure."

This letter transmits Security-Related Information. When separated from Enclosure 2, this letter is decontrolled.
