LICENSE AMENDMENT 45 - APPROVAL OF CHANGES TO THE FUNDAMENTAL NUCLEAR MATERIAL CONTROL PLAN (ENTERPRISE PROJECT IDENTIFIER L-2022-LLA-0180)
Dear Richard J. Freudenberger:
In accordance with your request dated November 30, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML22340A598), and pursuant to title 10 of the Code of Federal Regulations, part 70 (10 CFR), Materials License SNM-42 is hereby amended to approve the updated Fundamental Nuclear Material Control Plan (FNMCP) for BWXT Nuclear Operations Group, Inc. - Lynchburg, VA (BWXT NOG-L). The review of the U.S.
Nuclear Regulatory Commission (NRC) staff is documented in the enclosed safeguards evaluation report. Accordingly, Condition SG-5.1 of the SNM-42 has been modified to reference the FNMCP revised in November 2022 and will be updated in a future license amendment to reflect the date on the specific pages of the FNMCP, which your submittal stated would be changed to the implementation date after NRC approval. This letter concludes action on this application and Enterprise Project Identifier L-2022-LLA-0180 is considered CLOSED.
All other license conditions shall remain the same. The enclosures to this letter provide the amended Materials License SNM-42 and the safeguards evaluation report from the review of the updated FNMCP.
Enclosures 2 and 3 contain sensitive security-related information. Accordingly, those documents are marked as Official Use Only - Security-Related Information, and are withheld from public disclosure. When separated from Enclosures 2 and 3, this letter and Enclosure 1 are decontrolled and publicly available, in accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, of the NRCs "Agency Rules of Practice and Procedure."
This letter transmits Security-Related Information. When separated from Enclosures 2 and 3, this letter is decontrolled.
