LICENSE AMENDMENT 46 - APPROVAL OF PHYSICAL PROTECTION PLAN, REVISION 27 (ENTERPRISE PROJECT IDENTIFIER L-2023-SPR-0000)

Dear Daniel Ashworth:

This refers to letter 23015, dated March 28, 2023 (not publicly available due to security-related information in the cover letter and classified information in the enclosure), in which BWXT Nuclear Operations Group, Inc. - Lynchburg, Inc. (BWXT NOG-L) submitted proposed changes to the Physical Protection Plan (PPP). The enclosure to the letter provided descriptions and justifications for the proposed PPP changes. BWXT NOG-L stated in the letter that a copy of the updated PPP (Revision 27) will be transmitted to the U.S. Nuclear Regulatory Commission (NRC), following the review and approval of the PPP changes by the NRC.

By correspondence dated June 6, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23163A124), the NRC provided a Request for Additional Information (RAI) to BWXT NOG-L. By letter 23-41, dated June 27, 2023 (not publicly available due to security-related information in the cover letter and classified information in the enclosure), BWXT NOG-L responded to the NRC staffs RAI and revised the proposed changes to the PPP.

The NRC staff has completed its review of the request. The NRC has determined that the proposed changes to the PPP are acceptable, and issuance of this license amendment will not significantly impact the public health and safety and the environment, will not be inimical to the common defense and security, and will not endanger life or property or the common defense and security.

Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Sections 70.32(e) and 70.34, Safeguards Condition SG-6.1 of Materials License SNM-42 is hereby amended to reference Revision 27 of the PPP, submitted as Revision 27 by letter dated March 28, 2023, as revised by letter dated June 27, 2023.

The letter transmitted contains Security-Related Information. When separated from Enclosures 2 & 3, this letter is decontrolled.

The NRC staffs review is documented in a Safeguards Evaluation Report, which is Enclosure 3 to this letter. This letter concludes action on this submittal, and Enterprise Project Identifier L-2023-SPR-0000 is considered CLOSED.

Enclosures 2 and 3 contain sensitive security-related information. Accordingly, they are marked as Official Use Only, and are withheld from public disclosure. When separated from the sensitive enclosures, this letter and Enclosure 1 are decontrolled and publicly available, in accordance with 10 CFR 2.390 of the NRCs "Agency Rules of Practice and Procedure."

In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter and Enclosure 1 will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
