The 456th meeting of the Advisory Committee on Reactor Safeguards was held in Conference Room 2B3, Two White Flint North Building, Rockville, Maryland, on September 30-October 2,1998. The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda. The meeting was open to public attendance. There were no written statements nor requests for time to make oral statements from members of the public regarding the meeting.

Dr. Robert L. Seale, Committee Chairman, convened the meeting at 10:15 a.m.
and reviewed the schedule for the meeting.
II. NEl Petition to Modify 10 CFR 50.54(a) Related to Quality Assurance Procrams j (Open)

Introduction Dr. Robert Uhrig, Chairman of the Safety Research Program Subcommittee, I stated that the purpose of this meeting was to hear briefings by and hold discussions with representatives of the NRC staff and the Nuclear Energy institute (NEI) regarding the NEl petition to modify 10 CFR 50.54(a) related to
e 456th ACRS Meeting 2 k September 30-October 2,1998 quality assurance (QA) programs. The petition sought to broaden the scope of allowed unilateral changes that would not require prior NRC review and
' approval. NEl proposed to amend 10 CFR 50.54(a) to make changes exempt if they do not involve an unreviewed safety question as defined in 10 CFR 50.59 (Changes, tests and experiments).
Mr. Robert Gramm, NRR, stated that on June 8,1995, NEl petitioned the NRC to amend its regulations controlling changes to the QA programs. NEl proposed that the NRC change the criteria for submittal of QA programs such that only changes that are deemed to create an unreviewed safety question or a change in the technical specifications would require NRC approval.
The NEl petition would subject the QA changes to essentially the same criteria that exist pursuant to 10 CFR 50.59. NEl believes that the " reduction in commitment" standard is often used in instances that have little or no impact on
. safety. NEl contends that the industry expects considerable cost savings from the proposed changes.
Originally, the staff opposed the NEl petition because licensees should not be given such broad authority to change QA programs without NRC approval, and because licensees would take this opportunity to reduce the QA and design requirements for spent fuel dry cask storage equipment. Other reasons cited included the lack of specific guidance for the determination of an unresolved safety question, the need for increased QA controls in the light of component aging problems, the lack of an effective performance indicator program to monitor the effects of the changes, and the lack of industry preparation to implement such a program.
10 CFR 50.59 requires that a proposed change to a facility be deemed an unreviewed safety question if:
- - the probabi!ity of occurrence or consequences of a previously evaluated accident or equipment malfunction may be increased,
- the possibility for an accident or equipment malfunction of a different type may be created, or
= the margin of safety is reduced.
' The staff prepared a draft paper to obtain Commission approval to publish in the Federal Register a notice of partial acceptance of the NEl petition. The staff expressed appreciation for NEl's objection to the continued use of the present

10 CFR 50.54(a) criterion. For immediate relief to licensees, the staff is proposing to proceed with a Direct Final Rule, following appropriate interactions 1 with NEl, licensee representatives, and other interested parties, to revise 10 CFR '
50.54(a) to allow licensees to make additional changes to selected aspects of their QA program without prior NRC review or approval beyond that which is currently permitted. Unilateral QA program changes currently permitted include safety upgrades, corrections of typographical errors, and administrative improvements and clarifications. In addition, the staff plans to develop a process for changes that the licensees could voluntarily implement. Examples of these additional voluntary changes include:
adoption of consensus standards newly endorsed by the NRC, use of generic organizational and position titles, and elimination of descriptive QA program commitments that duplicate those contained in consensus QA regulatory standards Mr. Biff Bradley, NEl, was generally supportive of the NRC stafs proposal, but expressed concem regarding the stars proposed monitoring of the performance of QA programs. The use of a risk-informed approach to this performance monitoring appeared to be acceptable to NEl and the staff.
Condusion The Committee issued a report to Chairman Jackson dated October 20,1998, on this matter.

Subcommittee, stated that the purpose of this session was to hear a briefing regarding the stafs review of an amendment request to use a pilot application of ;
a risk-informed functional requirement for post-accident hydrogen monitoring at Arkansas Nuclear One.

, _450th ACRS Mceting 4 September 30-October 2,1998 NRC Staff Presentation Mr. Michael Snodderly stated that Entergy Operations Inc., requested relief from the requirements of NUREG-0737, which specifies continuous hydrogen monitoring of the containment atmosphere within 30 minutes following the initiation of safety injection, for Arkansas Nuclear One (ANO). The request was that this time be changed from 30 minutes to 90 minutes to reduce burdens on operation at entical times. The request was part of an industry initiative undertaken by the licensee and NEl in accordance with NEl Task Zero of the proposed Risk-informed, Performance-Based Pilot Program. The staff approved the licensee request via a confirmatory order and stated that similar requests are expar+ad from the other plants. The Committee also discussed this issue with Mr. Bob Christie, a representative from Performance Technology, Inc.
Conclusion The Committee issued a letter to the Executive Director for Operations dated October 14,1998, on this matter.
IV. Performance Technoloav. inc.. Views on Criteria for Safety Dari-bns (Open)

Introduction Dr. George Apostolakis, Chairman of the Reliability and Probabilistic Risk Assessment Subcommittee, introduced this topic to the Committee. He stated that Mr. Bob Christie of Performance Technology, Inc., had requested an opportunity to share his views on criteria for safety decisions and comments on Regulatory Guide (RG) 1.174 (formerly DG-1061) for risk-informed decisionmaking. He added that Mr. Christie also planned to discuss industry comments offered during the July 17,1998 Stakeholders meeting.
Performance Technology Presentation 4 Mr. Christie presented his views regarding the ACRS report dated May 11,1998, concoming elevation of core damage frequency (CDF) to a fundamental safety goal and possible revision to the Commission's Safety Goal Policy Statement.
He expressed disagreement with the use of CDF as a surrogate for public health and safety. Mr. Christie stated that the NRC only has responsibility for ensuring i

adequate protection and asserted that the use of CDF is overly restrictive. He also stated that criteria in RG 1.174 are arbitrary and suggested that the NRC is working to a " standard of perfection." Mr. Christie further stated that criteria in l RG 1.174 are de facto requirements and should be subject to backfit analysis l l per 10 CFR 50.10g.
Dr. Kress questioned what the public would tolerate an as acceptable level of l risk. Mr. Christie stated that it is not the NRC's role to decide what public l tolerance for risk should be and reiterated his view regarding adequate ,
l protection. He also stated that doing a probabilistic risk assessment changes the !
definition of adequate protection. Mr. Christie suggested that the NRC use the quantitative health objectives (QHOs) and reduce further regulatory oversight.
Dr. Apostolakis questioned how the NRC can regulate safety using such high- !
level criteria and suggested that Mr. Christie's view may be too extreme.

V. Industry initiatives to Certify Probabilistic Risk Assessments (Open) i

I Introduction Dr. George Apostolakis, Chairman of the Reliability and Probabilistic Risk Assessment Subcommittee, introduced this topic to the Committee. He stated that the purpose of this meeting was to review industry initiatives to certify
. probabilistic safety assessments (PSAs). He stated that the Committee would also review staff plans to consider certified PSAs in regulatory decisionmaking.
NEl Presentation Mr. Bradley, NEl stated that the PSA certification process is a self-assessment, peer review, and once-through process, which was first developed by the Boiling Water Reactor Owners Group (BWROG). He stated that the certification process is intended to be used to support industry applications for risk-informed inservice testing (IST), inservice inspection (ISI), graded quality assurance, and technical specifications. He also noted that all Owners Groups have initiated l
some form of PSA certification process. Mr Bradley stated that the certification L
456th ACRS Meeting 6 September 30-October 2,1998 process includes about 209 technical elements. Each element is reviewed and graded from the panel of PRA experts, utility, and NSSS representatives. He discussed the qualifications of the peer review panel and offered NRC an i opportunity to participate in the review process to better understand the !
certification process and disposition of identified weaknesses by the peer review team. l NRC Staff Presentation l
Messrs. Thomas King, RES, and Gary Holahan, NRR, presented the staff's view I of the industry certification initiatives. Ms. Mary Drouin, RES, provided i supporting discussion. Mr. King stated that key elements of a certification program should include the following:
standards to measure the sufficiency of models, technical quality, and incompleteness of PSAs;
- qualifications of the peer review team;
- closure of identified deficiencies; and a documentation necessary to support regulatory decisionmaking.
Dr. Kress questioned whether or not licensees would be expected to racertify their PSAs as part of their continued improvement program. Mr. Bradley stated that recertification is a voluntary individual plant decision at this time.

This briefing was for information only. The Committee plans to provide a report during a future meeting when it reviews the proposed ASME/ANS Standard on PRA quality.
VI. Lessons Leamed.from the Independent Safety Assessment of the Maine Yankee Atomic Power Station and Associated Generic Safety Imolications (Open)

Introduction Dr. Kress, Chairman of the Thermal Hydraulic Phenomena Subcommittee, introduced this topic to the Committee. He noted that the concems with the
- Maine Yankee Plant arose in 1995 following an allegation received by NRC
456th ACRS Meeting 7 September 30-October 2,1998 L pertaining to the adequacy of the licensee's emergency core cooling system code. Subsequent investigation, including the sta# independent safety assessment (ISA), found numerous issues - many with generic implications.
NRC Staff Presentations Mr. John Zwolinski, NRR, briefly discussed the history associated with this issue and introduced Mr. Daniel Dorman (NRR), who discussed the background and status of NRC staff actions taken as a result of the issue noted above. 1 Subsequent to the staff ISA, a Lessons Leamed Report was generated by NRR i and a Staff Action Plan was issued to address the 30+ actions identified.
l 1 i The individual actions were grouped into 11 categories. These categones included: adequacy of licensing reviews for power uprates, adequacy of the NRC l Inspection Program, public involvement in the assessment process, and the ,
I adequacy of NRC review of analysis codes. The majority (20) of the actions ;
l have been closed out. !
l To address issues associated with the stars review of analysis codes, a Thermal-Hydraulic (TM) Code Review Action Plan has been initiated. Mr. Ralph I Caruso outlined the stars objectives and schedule for this Plan. The products ;
of this Plan are development of a Standard Review Plan (SRP) Section and a !
Standard Format and Content Regulatory Guide to. ensure a structured, j consistent review process for licensee / vendor TM codes. In tandem with this action plan, NRR has initiated reviews of new licensee / vendor ECCS codes. )
The stars schedule calls for~ completion of the SRP/ Regulatory Guide by May 2000.
Dr. Seale expressed concem that the staff is proceeding with review of new TM codes, abs 6nt a structured review plan being in place. He indicated that the work on the standards should precede any reviews of new codes. Dr. Powers suggested that an ACRS Fellow be assigned to aid the Committee's review of this matter.
Conclusion This was an information briefing. No Committee action was necessary. The Committee willinitiate a detailed review of the NRC TM Code Review Action Plan in the near future.

Introduction I Mr. John Barton, Chairman of the Subcommittee on Plant Operations, stated that the Committee issued a report on March 13,1998, concoming proposed improvements to the Senior Management Meeting (SMM) process.
Subsequently, the Commission directed the staff to issue its proposed SMM l process for public comment and later directed the staff to suspend the j Systematic Assessment of Licensee Performance Program. Mr. Barton noted that the staff held a Workshop on the SMM process on September 28 - October 1,1998. He then introduced Mr. Michael Johnson, NRR, to begin the staff presentation.
NRC Staff Presentation Mr. Johnson presented the objectives of the workshop, an outline of the SMM process development, initial results of the workshop, and the next steps in the development of the process. Mr. Johnson explained the philosophical approach to regulatory oversight and the top-down approach used by the staff. He described the fundamental issues associated with the regulatory oversight framework and the development of the comerstones. Mr. Alan Madison, AEOD, !
presented the results of some of the workshop functionalissue breakout l sessions. Mr. Johnson presented the proposed staff schedule for developing and implementing a revised SMM process.
l Mr. Frank Gillespie, NRR, concluded the presentation by stating that the staff and industry are reaching agreement on the performance indicators that can be used to assess plant performance and that inspections should be used to validate the performance indicators. He noted that the NRC will maintain baseline inspections at all plants.
Mr. Stephen Floyd, NEl, congratulated the staff on its workshop and stated that the industry was willing to work with the staff in developing and implementing the assessment process. He noted that the area of least agreement was related to the integration of performance indicators with inspection results.

The Committee decided that it was satisfied with the EDO response.
EDO letter dated September 29,1998, responding to the ACRS letter dated September 15,1998, concoming the application for power level increase for Edwin 1. Hatch Nuclear Power Plant, Units 1 and 2.
The Committee decided that the EDO response was unacceptable and planned to write another letter.
C. Report on the Meeting of the Planning and Procedures Subcommittee (Open)
The Committee heard a report from the Deputy Executive Director, ACRS, on the Planning and Procedures Subcommittee meeting held on September 29,1998. The following items were discussed:
MANAGEMENT CHANGES - LETTER TO MR. CAI I AN Since the last ACRS meeting, Mr. Joseph Callan, NRC Executive Director for Operations (EDO), has announced his retirement effective October 16,1998, and Dr. William Travers has been selected to replace him. A draft ACRS letter has been prepared thanking Mr. Callan for his close cooperation with the Committee.
RECOMMENDATION The Subcommittee recommends that the Committee discuss and approve the subject letter.
EFFECT OF RECENT CHANGES IN EDO PRIORITY ISSUES ON ACRS SCHEDULE During the September 2-4,1998 ACRS meeting, the Committee agreed to reapportion the workload between Members. A new task

The EDO's Office was asked to identify those issues where ACRS is on the critical path. John Larkins, Richard Savio, and Sam Duraiswamy plan to work with Jocelyn Mitchell, OEDO, to identify problem areas as they arise.
Members were reminded that a follow-up Stakeholders' Meeting has been scheduled for Friday, November 13,1998, in the ACRS Conference Room. ACRS Members were encouraged to attend and participate.
RECOMMENDATION The Subcommittee recommended that John Larkins, Richard Savio, and Sam Duralswamy meet periodically with Jocelyn Mitchell to identify problem areas as they arise, and keep the cognizant ACRS members informed, in addition, it was recommended that Members review the new priority issu3s task list.
Members who wish to attend the Stakeholders' Meeting on November 13,1998, should notify the Executive Director. The ACRS staff plans to provide the meeting agenda to the Members as it becomes available.

REGULATORY REFORM AND PERFORMANCE ASSESSMEN,I l WORKSHOP 1 Jack Sorensen, ACRS Fellow, has been following staff and industry initiatives on regulatory reform and will discuss current industry priorities. He attended the Performance Assessment public workshop, held on September 28-October 1,1998, to discuss improvements to the NRC performance assessment process. He plans to prepare a summary report on this workshop which will be distributed to the Members after the full Committee meeting.
RMQQEI The NRC budget for FY 1999 and FY 2000 has not yet been approved by Congress. Until Congress passes its Appropriations Bill for NRC, the ACRS will continue to function under a continuing

However, the Congress passed the Defense Appropriations bill in which it designated $3.2 million for NRC l regulation of DOE projects, without specifying facilities. QUADRIPARTITE MEETING All Members attending the Quadripartite Meeting in Japan should have received a package from Kaoru Naito enclosing a complete agenda for the meeting, instructions for transportation from the airport to the hotel, and a program for attending spouses.
