Caswell, By letter dated October 1, 2003 Southern Nudear Operating Company (SNC) responded to Inspection report 0500032112003006 and 05000366/2003006. The letter provided information upon which SNC based a request for the URls to be closed. Subsequent discussions have occurred between my supervisor, Mr. Ray Baker, and Mr. Ogle. Mr. Baker is attending the Regulatory Information Conference (RIC) this week and will be back in the office on Monday. I request that additional response on the URIs be suspended until Mr. Baker can be involved.

Unanalysed Condition Involving Spurious Opening of SRVs Inspection report 05000321/2003006 and 05000366/2003006 identified a concern involving lack of objective evidence which demonstrated that post-fire SSD equipment could adequately mitigate a fire In Fire Area 2104, If all eleven SRVs were spuriously opened. The report further stated that if all eleven SRvs were opened ( with the reactor at 100% power), prior to scramming the reactor, this event could place the plant in an unanalyzed condition. In order to ensure that this concern would be addressed by Southern Company, the inspection team opened URI 50-366/03-06-01, Concerns Associated with

I discussed my continued concern regarding this issue with my immediate Supervisor on 0311012004. Specifically, I have seen no progress made by Southern Company for providing the analysis discussed in the above report. I was advised by my Supervisor to reiterate my concern regarding this issue with Southern Company.

It is my belief that the objective evidence discussed in the report is required to be presentd to the NRC and evaluated by appropriately qualified personnel for technical adequacy. Additionally, as the team leader having responsibility for closing URI 50-366/03-06-01, it is my belief that this analysis will provide the technical basis which justifies closing URI 50

-366/03-06-01. We are requesting information concerning the status of the analysis required for closure of this URI.
