Dear Mr. Miraglia:

The Fish and Wildlife Service has reviewed the supplement to the Endangered or Threatened Species Assessment for the St. Lucie Plant, Unit 2, Operating License Stage Review, forwarded to this office on March 24, 1982. This letter augments our letter of January 19, 1982, regarding Section,7 requirements of the Endangered Species Act for the St. Lucie Power Station located on Hutchinson Island, St. Lucie County, Florida.

Under provisions of the staff recommendations contained on pages iii-v of the Assessment, the NRC license would require certain studies by the applicant. In particular, the applicant has agreed to conduct a beach survey and nest relocation program during this season's construction activity and nesting surveys for 5 years thereafter. Additional conditions have been identified to evaluate and minimize entrainment and recovery impacts to marine turtles. We note that a built-in interagency review of the entire program has been planned which will be triggered by the results of proposed entrainment studies. We believe that this is a prudent approach and will serve to maintain program flexibiity while requiring progress toward a solution to the entrainment problem.

Based on information contained in the initial and supplemental biological assessments, and provided that the staff recommendations are made a part of the NRC License, the Service concurs in your determination that the remaining construction activities and the operation of both St. Lucie units will have no effect on any listed species under jurisdiction of this agency. However, we request that a report of the nest survey and relocation program be provided to this office and that the Fish and Wildlife Service be afforded an opportunity to participate in the interagency program review meeting.

However, it does fulfill the requirements of the Act and no further action on your part is required. If modifications are made in the project or if additional facts involving impacts on listed species arise, consultation should be reinitiated.
