Attached for your files is a copy of the recently issued National Pollutant Discharge Elimination System Permit No. FL0002208 for the St. Lucie Nuclear Plant and the associated Section 316(b) Findings.
As discussed with manbers of your staff, the Environmental Pzotection Agency feels that the Nuclear Regulatory ComIission is the Lead Federal Agency in consulting with the National WL zine Fishezies Service and Fish and Wildlife Service re1ative to Sea Turtles at the Hutchinson Island Site.
We have therefore approved the Novembez
- 1981, "Proposed St. Lucie Plant Preoperat'onal and Op rational Biological Monitoring Program," but have notified Florida Power and Light Company (See enclosed letter}, that the approval does not include those portions of the Program relating to sea turtles.
It is our un erstanding that both terrestrial and aquatic studies for sea turtles vill be required by the Nuclear Regulatory Coamission.
We concur with the need for improvements in excluding turtles from the intake structures and in the return pzocedures.
Our staff rmIins available to assist the Nuclear Regulatory Carmission in developing necessary conditions and requirements.
It would be appreciated if you would keep us abreast of results of this program as it could impact future Section 316(b) Determinations for Ocean intake structures Sh contact us.

Dear Mr. Uhrig:
Enclosed is the National Pollutant Discharge Elimination System (NPDES) permit for the above referenced facility.
This action constitutes a final permit decision under Title 40, CRT of Federal Regulations, Section 124.60 (45 FR 33495, Wy 19, 1980).
Also enclosed are the permit Rationale, Section 316(b)
- Findings, and Response to Comments.
Except as noted below, the biological study plan entitled "Proposed St. Lucie plant Preoperational and Operational Biological Monitoring program August 1981," is hereby approved and should be conducted in accordance with Part III.
F. of the Permit.
Applicable provisions of the program relating to Sea Turtles are not covered by the NPDES Permit.
NRC is considered to be the Lead Federal Agency relative to consultation under the Endangered Species Act and will incorporate aquatic and terrestrial monitoring requirements in the St.
Lucie Environmental Protection plan.
We have reviewed your December 3, 1981, submittal relative to the third intake and have met with NRC and NMFS.
We hereby determine that the two existing intakes and the third proposed intake constitute "best technology available" in accordance with Section 316(b) of the Clean Water Act.
- However, as noted in the Findings for the third intake, we strongly feel that improvements to prevent entrapment of sea turtles and improved return provisions should be sought o
We also concur hereby that t'ne "St Iacie Plant Auxiliary Cooling Mater System Monitoring Program" as submitted on September 15, 1981, is acceptable in meeting Permit requirements for intensively monitoring the auxiliary cooling systems contained on pages I-1 and I-3 for oxidants; In accordance with your request of January 26, 1982, the permit is effective on sigpature.
