I. COMMENTS BY NEW YORK STATE ELECTRIC & GAS.

A. Preliminary Statement And Background.

On July 11, 1979 New York State Electric & Gas Corporation (the applicant or NYSE&G) filed comments on the proposed protocol for joint hearings (joint protocol) and Department of Public Service Staff's (Staff) second set of proposed discovery rules which were transmitted to the parties on May 28, 1979. The applicant proposes changes to the joint protocol and discovery rules which relate to the timing and process of identifying " contentions" or " issues" that will subsequently be the focus of evidentiarj hearings.

The joint protocol as proposed by Staff calls for issue identification following issuance of the Draft Enviren-mental Statement (DES).
