In a "Brief on Standing" dated July 13, 1979, the NRC Staf f submitted an affidavit of Charles M. Ferrell concerning the geographic area which might be impacted by an accident at the crew Haven site.
We are advised that the NRC has recently received a report by Beyea and Von Hippel which contradicts Mr. Ferrell5 af fidavit.
We hereby request that you take judicial notice of the contents of such report.
If, nevertheless, you are inclined at this time to make any rulings based upon Mr. Ferrell's assertions, we hereby request the opportunity to explore thase assertions at an evidentiary hearing prior to the time that you make any such ruling.
