Dear Mr. Sells:

SUBJECT:

New Haven Nuclear Station With the dismissal of the New Haven Nuclear Station application by the Siting Board, along with the decision by the Nuclear Regulatory Commission to terminate further processing of this case, it is apparent that New York State will not be providing further assistance in preparing the Federal Environ-mental Statement as originally contemplated under the Technical Agreement between the State and NRC.

As you know, the Department of Public Service staff initiated work on the New Haven environmental statemer.t before it became apparent that the case would..not go forward and prior to the signing of a formal contract. This was done in anticipa-tion that a contract would be signed and was mutually agreed to because of the extremely stringent time schedule for completion of the environmental statement.

With the approach of the end of the state fiscal year, we would like to close-out our account in this matter. Accord-ingly, the Department of Public Service herewith seeks compensa-tion for costs incurred for services performed.
