This is in response to your letter of August 2,1996, in which the U.S. Nuclear Regulatory Commission requested information from me to show that the performance of my licensed duties was consistent with the terms of my license including 10 CFR 55.25 and 10CFR55.53(g). The reason for this request was my indictment on various felony charges by the Conunonwealth of Massachusetts for alleged activities that were unrelated to my work as a licensed senior reactor operator.

In response to the NRC request, let me first state unequivocally that I did not conunit any of the acts of which I have been accused, and that I expect to be acquitted of all charges. Second, I am very ap?reciative of the actions taken by my employer, the Massachusetts Institute of Techno.ogy, to support me during this very difficult time. MIT has provided NRC with a copy of its policy (dated June 26,1996). MIT has structured this policy so that its responsibility to ensure safe operation of the MIT Research Reactor is fulfilled and at the same time my rights are preserved. I want the U.S. Nuclear Regulatory Commission to understand that I have the same goals. I have held a responsible position at the MIT Nuclear Reactor Laboratory for the past eleven years, and my primary concern is the safe operation of that facility.

In response to the two specific issues raised in the NRC letter of August 2,1996 to me, I am providing the following information, a) 10CFR50.25 - I have taken several actions to ensure that I remain capable of performing both my licensed and supervisory duties. These include:

(i) I voluntarily informed all of my co-workers and colleagues of the indictment and explained my situation to them.

(ii) I scheduled physicals with both MIT Medical and my personal physician. Both approved my continuing to work at the MITR.

. .l , Pye Two (iii) I will take time off from work whenever I am likely to be in a high stress situation as a result of these legal difficulties.

(iv). I interact regularly with the Director of Reactor Operations and the Administrative Officer, both of whom have responsibilities to monitor myjob performance.

b) 10CFR55.53(g) - In the event such certification is necessary, it will be -

made with the prescribed time frame. However, I do not expect that such will be the case.

I am requesting pursuant to 10CFR2.790(7)(iii) that both this letter and the NRC's letter to me of 2 August 1996, be withheld from the Public Document Room (PDR). MIT has, in its correspondence to the NRC on this matter, scrupulously avoided mention of my name. These two letters identify me. I am not guilty, and I submit that the placement of 4

these letters in the Public Document Room, therefore, constitutes an unwarranted invasion of privacy. If I am convicted, I will withdraw my objection. But for the present, I do object. In addition, the NRC's letter to MIT on the same subject also mentions me by name. I am, therefore, rt. questing that it too be withheld from the Public Document Room or that the letter be amended to delete my name before being placed in the Public Document Room.
