Gentlemen:

On June 26,1996, the Massachusetts Institute of Technology informed the U.S.

Nuclear Regulatory Commission in writing that one of its licensed senior reactor operators had been indicted by the Commonwealth of Massachusetts on various felony charges.

These charges were unrelated to the employee's duties at MIT, and a ne of the alleged allegations occurred at MIT. In that letter, and in a subsequent one ted September 6, 1996, MIT agreed to keep NRC informed of significant develop 4 %s in the matter.

Accordingly, NRC is hereby notified that a trial date has been tentat.My set for January 15, 1998. The trial itself is expected to last five to six weeks. Our policy toward the employee will continue to be as outlined in our letter of September 6,1996.
