On April 24,1998, the Massachusetts Institute of Technology notified the U.S. NRC that one of its licensed reactor operators would be tried on a number of criminal charges by the Commonwealth of Massachusetts, commencing 27 April 1998. That trial has now been initiated.
We are writing to inform you that a subpoena has been served on the Massachusetts Institute of Technology to provide all reactor console logs from 1983 through the present. We wish to reiterate that none of the alleged criminal activities occurred at MIT or in any way involved MIT.
The reason for the subpoena is to establish the defendant's alibi.
Specifically, it is our understanding that one of the contentions of the prosecutor is that the individual involved spent a period of eighteen months in another country masterminding a criminal activity. The individual's i
passport and MIT pay records clearly contradict this. Nevertheless, the prosecution is adamant conceming its assertion. Accordingly, the console log records have been subpoenaed in an effort by the defense to prove that the individual was in fact at MIT on a daily basis, which he was.
We recognize that access to these records is important to the Nuclear Regulatory Commission's capability to inspect our facility. It is our understanding that should the U.S. NRC need access to these documents during the time frame in which they have been subpoenaed such access will be granted. A letter stating this requirement has been sent to the issuer of this subpoena.
